Is Nicotine legal in Ireland?

Legal status
Not a controlled drug and expressly outside the psychoactive substances regime. Nicotine is not named in the Misuse of Drugs Regulations 2017, and section 2(1)(d) of the Criminal Justice (Psychoactive Substances) Act 2010 excludes a tobacco product within the meaning of section 2 of the Public Health (Tobacco) Act 2002.
Consequences if caught
Both instruments were read against this substance. Section 2(1) of the Criminal Justice (Psychoactive Substances) Act 2010 excludes medicinal products, authorised animal remedies, intoxicating liquor, tobacco products, food placed on the market in compliance with food legislation, and controlled drugs. So the Misuse of Drugs Act is read first and the 2010 Act reaches only what that Act does not. Section 1 defines a psychoactive substance by effect and not by name: a substance, product, preparation, plant, fungus or natural organism which has, when consumed by a person, the capacity to produce stimulation or depression of the central nervous system resulting in hallucinations or a significant disturbance in, or significant change to, motor function, thinking, behaviour, perception, awareness or mood, or to cause a state of dependence. There is no list. Because a tobacco product is excluded by section 2(1)(d), the sale offence in section 3 does not reach it, and there is no Misuse of Drugs Act offence either. Age limits, advertising and the places where smoking is allowed are set by the Public Health (Tobacco) Acts, which were not read here.

Nicotine replacement products are medicinal products or general sale items depending on the product. No controlled drug prescription is involved.
