Modafinil is absent from Turkey's closed narcotics list. The finding is specific to Turkey and should not be generalised: modafinil is a scheduled controlled substance in a number of other countries, and a traveller who reasons from the Turkish position outward will be wrong about the next border. Article 19 of Law No. 2313 brings a substance under the narcotics law only where a Presidential decision names it, and the annexes to those decisions were not reproduced in the consolidated text, so this row rests on the dossier's completed search rather than on a schedule this author read.

Consequences if caught

Capital exposure: none. No controlled drug capital, life or quantity rule attaches, because the substance is absent from the closed narcotics list; separate regulatory law may still apply. Articles 188 and 191 of Penal Code No. 5237 do not engage, so neither the thirty year ceiling in 188(1) nor the two to five year use offence in 191(1) applies to modafinil, and no quantity converts a supply of tablets into a narcotics charge. What remains in view is medicines law: supplying a prescription medicine outside the pharmacy system is a regulatory offence under that law rather than under this chapter, and article 187 of the Penal Code sets one to five years and a judicial fine only at the outer edge, for producing or selling a medicine in a way that endangers life and health.
