Is Mescaline legal in Turkey?

- Mescaline is a controlled substance in Turkey and the dossier carries it under the schedule name mescaline, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. The entry reaches the alkaloid and stops there. The peyote row in this corpus was searched under «peyote» and «Lophophora williamsii» and returned no confirmed entry, and the dossier expressly rejected reading mescaline across to it «because the constituent does not settle the cactus material». That is the correct construction of a closed list statute: article 19 brings named substances under the Law by Presidential decision and contains no clause extending an entry to the plants that produce it, which is why cannabis needed its own express words in article 3 and its own cultivation offence in article 23. A cactus is therefore not settled by this row and a purified alkaloid is.
- Consequences if caught
- Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, with aggravating multipliers in article 188(4), (5) and (8). Article 188(3) sets not less than ten years for selling, offering for sale, giving to another, dispatching, transporting, storing, purchasing, accepting and possessing without licence or contrary to licence. Article 188(5) raises that by one half where three or more people act together and doubles it where the conduct falls within the activity of an organisation formed to commit crime, and neither limb requires a quantity finding. On the user side article 191(1) sets two to five years, with the five year deferral of 191(2) and at least one year of denetimli serbestlik under 191(3), during which the Public Prosecutor orders the person referred for testing at least twice a year.
- If prescribed or medical
- There is no prescription route for mescaline in Turkey. It has no marketed medicinal preparation, the dossier recorded no prescription instrument for this row, and no per-substance medical route is asserted here. Religious or ceremonial use is not addressed in either instrument the dossier read, and article 188(6) of the Penal Code, which extends the trafficking paragraphs to permission bound or prescription bound substances producing a narcotic or stimulant effect, does not create an exemption of that kind. A foreign prescription is not a Turkish authorisation.

- No document makes mescaline lawful to carry. For plant material the practical point is that identification decides the charge: article 20 of Law No. 2313 requires a sample sufficient for analysis to be taken from any seized narcotic substance and sent to the relevant laboratory, so a cactus described as ornamental and a cactus found to contain the scheduled alkaloid can be the same object with two different outcomes. The peyote row is separately unconfirmed and is not a permission. The schedule name was read in the dossier on 18 September 2026 and articles 19 and 20 with articles 188 and 191 were read from the consolidated texts on 20 September 2026.
