Is GHB legal in Turkey?
- Legal status
- GHB is a controlled substance in Turkey and the dossier carries it under the schedule name ghb, a VERIFIED placement in the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances. Its precursor is not in the same position. The GBL row in this corpus was searched under «gama-bütirolakton» and «GBL» and returned no confirmed entry, and the dossier rejected reading GHB across to it «because GBL is the lactone precursor, not GHB». That gap is closed, if at all, by the precursor provisions rather than by the schedule: article 188(7) of Penal Code No. 5237 reaches a substance which does not itself produce a narcotic or stimulant effect but is used in the production of one and whose import or manufacture depends on the permission of official authorities. So GHB is scheduled by name, and the industrial chemical that converts to it in the body is governed, if at all, by a different mechanism that this corpus did not confirm for it.
- Consequences if caught
- Capital exposure: none. The cited instruments give no per-substance numeric quantity threshold; purpose and circumstances are assessed case by case, and the ceiling is 30 years under article 188(1) of Penal Code No. 5237, with aggravating multipliers in article 188(4), (5) and (8). GHB is carried as a liquid in millilitre doses, so the absence of any weight rule is particularly consequential here and the assessment rests on purpose and circumstances rather than on volume. Article 188(3) sets not less than ten years for domestic sale, supply, dispatch, transport, storage, purchase, acceptance and possession. Article 188(7) sets a separate floor of «sekiz yıldan az olmamak üzere hapis ve bin günden yirmibin güne kadar adlî para cezası», not less than eight years with a fine of one thousand to twenty thousand days, for importing, manufacturing, selling, buying, dispatching, transporting, storing or exporting a permission bound precursor used in narcotic production. On the user side article 191(1) sets two to five years, with the five year deferral of 191(2) and at least one year of denetimli serbestlik under 191(3).
- If prescribed or medical
- There is no traveller prescription route for GHB in Turkey. Sodium oxybate exists as a licensed narcolepsy medicine in some countries, but the dossier carried no prescription instrument for this row and made no finding on Turkish marketing authorisation, so nothing here should be read as confirming that such a product can be dispensed or imported. Article 188(6) of the Penal Code extends the trafficking paragraphs to substances whose production is permission bound or whose sale is prescription bound and which produce a narcotic or stimulant effect, while allowing the sentence to be reduced by up to half; whether a licensed oxybate product falls within it is exactly the question the dossier leaves open. Settle any such product with the TİTCK before travelling.

- No document makes recreational GHB lawful to carry, and a colourless liquid in an unlabelled bottle is the least documentable item in this corpus. Article 20 of Law No. 2313 requires a sample sufficient for analysis to be taken from a seized substance, so the contents of a water bottle are established by report rather than by explanation. A person prescribed sodium oxybate should carry the original dispensing packaging, the prescription and a prescriber's letter naming the patient, the active ingredient, the dose and the treatment period, and obtain the TİTCK position in advance. The schedule name was read in the dossier on 18 September 2026 and articles 188(3) and 188(7) were read from the consolidated Penal Code on 20 September 2026.
