Is Etizolam legal in Ireland?

Legal status

Not a controlled drug, but selling it for human consumption is an offence. Etizolam is not named in the Misuse of Drugs Regulations 2017. The Criminal Justice (Psychoactive Substances) Act 2010 catches substances by their effect rather than by name, and its offences are sale, import and export. There is no possession offence.

Consequences if caught

Etizolam was searched for in the cached copy of the Misuse of Drugs Regulations 2017 and is not named. Section 2(1) of the Criminal Justice (Psychoactive Substances) Act 2010 excludes medicinal products, authorised animal remedies, intoxicating liquor, tobacco products, food placed on the market in compliance with food legislation, and controlled drugs. So the Misuse of Drugs Act is read first and the 2010 Act reaches only what that Act does not. Section 1 defines a psychoactive substance by effect and not by name: a substance, product, preparation, plant, fungus or natural organism which has, when consumed by a person, the capacity to produce stimulation or depression of the central nervous system resulting in hallucinations or a significant disturbance in, or significant change to, motor function, thinking, behaviour, perception, awareness or mood, or to cause a state of dependence. There is no list. The offences are narrower than the definition. Section 3(1) makes it an offence to sell a psychoactive substance knowing or being reckless as to whether it is being acquired or supplied for human consumption, and section 3(2) does the same for import and export. There is no possession offence in the Act. Section 20 sets the penalty at a fine not exceeding 5,000 euro or imprisonment not exceeding 12 months or both on summary conviction, and a fine or imprisonment not exceeding 5 years or both on conviction on indictment.

If prescribed or medical

A medicinal product is excluded from the 2010 Act by section 2(1)(a), so a prescribed medicine is outside it. Carry any prescribed medicine in its original packaging with the prescription.

Documentation

For a prescribed controlled medicine on international travel, carry the original packaging and the prescription. Ireland is not in the Schengen area, so a Schengen certificate is not the Irish document, and the requirement for any particular journey was not established here.
