Is Ephedrine legal in Spain?

Legal status

Not a controlled substance on the text read, but a scheduled drug precursor: Ephedrine is not named in Anexo 1 or Anexo 2 of Real Decreto 2829/1977, and it is not in the 1961 Convention lists that Ley 17/1967 article 2 incorporates. Search log: «efedrina» returned 0 whole word hits in Anexo 1, 0 in Anexo 2 and 0 in the Yellow List (1, 0 and 1 counting it inside longer words). The hit for «efedrina» is Lista III entry 4, cathine, where the letters sit inside «(+)-norpseudoefedrina»; norpseudoephedrine is a different substance. Nor is it in the 1971 Convention schedules as printed in the English INCB Green List, 36th edition, 2025: «Ephedrine» returned 0 whole word hits there. The psychotropic annexes are a closed enumerated list: the stems «análog» and «isómer» return 0 and 1 hits across both annexes, the one «isómer» hit being zipeprol's own entry covering its stereoisomers, so there is no analogue or generic clause. A substance enters only when a later instrument adds its name: article 1 extends the decree to substances «o bien que en futuro puedan ser incorporadas a las Listas o la Relación», ministerial orders have amended Anexo 1, and article 4 lets the Dirección General amend Anexo 2 «mediante Resolución, podrá modificar el contenido de la Lista de principios activos contenidos en el anexo dos» (may, by resolution, amend the list of active ingredients in annex two). The lists are read as at the Real Decreto 2829/1977 consolidation published 21/04/2026 and in force from 22/04/2026. Narcotic absences are decided through Ley 17/1967 article 2 against the INCB Yellow List, 65th edition of July 2026; the INCB Green List, 36th edition updated December 2025, is a cross-check for psychotropics. Narcotics can also be designated nationally, «en el ámbito nacional por el procedimiento que reglamentariamente se establezca» (nationally, by the procedure set by regulation); Real Decreto 1194/2011 sets that procedure and so far names tapentadol and isotonitaceno, as consolidated to 8 June 2021. 1971 Convention decisions after December 2025 and 1961 Convention decisions after July 2026 were not read, and this does not rule out a later amendment.

Consequences if caught

Ephedrine is a precursor. The 1988 Vienna Convention, as published in the BOE on 10 November 1990, prints «Efedrina.» in its Cuadro I (read from the page image), and Código Penal article 371 punishes whoever makes, transports, distributes, trades or holds substances «enumeradas en el cuadro I y cuadro II de la Convención de Naciones Unidas, hecha en Viena el 20 de diciembre de 1988» «a sabiendas de que van a utilizarse en el cultivo, la producción o la fabricación ilícitas de drogas tóxicas, estupefacientes o sustancias psicotrópicas», with «prisión de tres a seis años y multa del tanto al triplo del valor de los géneros o efectos». Knowledge of illicit manufacture is the element; holding a medicine containing ephedrine is not that offence. Two smuggling routes in Ley Orgánica 12/1995 could apply to import or export, and the text does not settle which. Article 2.2 c) 3.º covers trade contrary to «La normativa reguladora del comercio exterior de precursores de drogas sin las autorizaciones a las que se refiere el Reglamento (CE) n.º 111/2005» (the rules on external trade in drug precursors, without the authorisations required by Regulation (EC) No 111/2005), and article 2.2 applies only where the goods are worth 50,000 euros or more («siempre que el valor de los bienes, mercancías, géneros o efectos sea igual o superior a 50.000 euros»). Article 2.4 adds up several acts: it is also smuggling where someone, «en ejecución de un plan preconcebido o aprovechando idéntica ocasión, realizare una pluralidad de acciones u omisiones previstas en los apartados 1 y 2 de este artículo» (as part of a preconceived plan or on the same occasion, carries out several acts or omissions provided for in sections 1 and 2 of this article), «cuyo valor acumulado sea igual o superior a dichos importes» (whose combined value equals or exceeds those amounts), and article 2.5 adds «Las anteriores conductas serán igualmente punibles cuando se cometan por imprudencia grave.» (the same conduct is punishable when committed through gross negligence). Below that value the same conduct is an administrative smuggling infringement under article 11.1, «cualquiera que sea el valor de los bienes, mercancías, géneros o efectos, cuando dichas conductas no constituyan delito» (whatever the value of the goods, when the conduct is not a crime). The law defines drug precursors in article 1.15 as «las sustancias y productos susceptibles de ser utilizados en el cultivo, la producción o la fabricación de drogas tóxicas, estupefacientes o sustancias psicotrópicas enumeradas en los cuadros I y II de la Convención de Naciones Unidas, hecha en Viena el 20 de diciembre de 1988» (substances and products listed in Tables I and II of the 1988 Vienna Convention that can be used in the cultivation, production or manufacture of toxic drugs, narcotics or psychotropic substances). Article 2.3 a) applies at any value to «sustancias químicas tóxicas y sus precursores» (toxic chemical substances and their precursors), which article 1.16 defines as «las sustancias enumeradas en las listas 1, 2 y 3 de la Convención sobre la prohibición del Desarrollo, la Producción, el Almacenamiento y el Empleo de Armas Químicas» (the substances in lists 1, 2 and 3 of the Chemical Weapons Convention), while article 5.6 describes offences under 2.3 a) as including drug precursors, «o de precursores de las mismas, tipificados en el artículo 2.3 a) de esta Ley Orgánica» (or of their precursors, defined in article 2.3 a) of this Organic Law). Separately, Orden SCO/190/2004, an order made under the former Ley 25/1990, lists row 73 as «Ephedra sp.» among plants whose sale to the public «así como la de sus preparados, queda prohibida por razón de su toxicidad» (and that of their preparations, is prohibited because of their toxicity). That is a sale rule, not drug control. Its current force is not established: the BOE record read on 2 October 2026 shows no later amendment or annulment, and a 2005 Audiencia Nacional judgment is reported in secondary listings as declaring the order void; that judgment was not read. No penalty is stated from the order. For medicines, article 361 punishes trading in «medicamentos, incluidos los de uso humano y veterinario, así como los medicamentos en investigación, que carezcan de la necesaria autorización exigida por la ley» where «con ello se genere un riesgo para la vida o la salud de las personas», with six months to three years; a patient holding a medicine prescribed to them is not that offence.

If prescribed or medical

Spain runs two medicine control regimes side by side: narcotic medicines under Ley 17/1967 and psychotropic medicines under Real Decreto 2829/1977. Under the medicines law the Spanish medicines agency classifies each authorised medicine, «En la autorización del medicamento, la Agencia Española de Medicamentos y Productos Sanitarios determinará sus condiciones de prescripción», as «Medicamento sujeto a prescripción médica» or «Medicamento no sujeto a prescripción médica». The Spanish medicines register (CIMA), queried on 2 October 2026 by active ingredient «efedrina», lists 14 products carrying it of 52 records returned; their conditions are 10 hospital use only (printed «Uso Hospitalario»), 2 prescription only (printed «Medicamento Sujeto A Prescripción Médica»), 2 without prescription (printed «Sin Receta»).

For an ordinary medicine the agency's guidance says the medicines law «permite a los viajeros llevar su medicación personal» (allows travellers to carry their personal medication) and recommends carrying «una prescripción/informe del médico» (a doctor's prescription or report).
