Is DXM legal in Poland?
Also known as: robo, dextromethorphan
- Legal status
- Not named in the Polish national list, and the exclusion is express rather than a silence. The 2025 amending regulation rewrote «LEWOMETORFAN*)» at lp. 115 and «LEWORFANOL*)» at lp. 117 of group I-N and added a footnote row to the table, marked to those two entries, reading «Z wyłączeniem substancji dekstrometorfan» and continuing with the chemical designations of dextromethorphan and dextrorphan. So the annex reaches the levorotatory morphinans and says in terms that it does not reach their dextrorotatory counterparts.
- Consequences if caught
- Capital exposure: none. Poland has no death penalty, and no drug offence attaches to this row at all on the list as read. That makes this a positive statement of absence by the instrument rather than a failure to find an entry, which is a materially stronger finding than an ordinary search returning nothing. Racemethorphan remains listed at lp. 167 of the same group, so a racemic preparation is not covered by the exclusion. Dextromethorphan remains a pharmacy medicine under Polish pharmaceutical law, and that regime was not read in this pass. This absence is stated as at the consolidated text of 17 June 2024, Dz.U. 2024 poz. 1139, as that text stands after the amending regulations of 30 April 2025, Dz.U. 2025 poz. 598, and of 7 July 2026, Dz.U. 2026 poz. 934, read at api.sejm.gov.pl on 21 September 2026. The power to move the list belongs to the Minister of Health, exercised by rozporządzenie under article 44f of the 2005 Act, and that does not rule out a later rozporządzenie made after the date of this reading.
- If prescribed or medical
- Sold as an antitussive under pharmaceutical law rather than as a controlled medicine. No controlled prescription form applies.
- Documentation
- No controlled drug documentation arises under the drug law, because the annex expressly excludes the substance.
