Is DXM legal in Netherlands?

Legal status

Dextromethorphan is not controlled under the Opiumwet as a lijst I or lijst II substance: lijst I expressly excludes it. The closing clause of lijst I extends the list to «de ethers, esters en enantiomeren van de bovengenoemde substanties, met uitzondering van dextromethorfan (INN) als enantiomeer van levomethorfan en racemethorfan» (in English, the ethers, esters and enantiomers of the substances above, with the exception of dextromethorphan (INN) as the enantiomer of levomethorphan and racemethorphan). Lijst II does not name it and carries no enantiomer clause. Nor is it designated under article 3a, fifth limb, which would bring it under the lijst I or lijst II prohibitions: such a designation lapses «uiterlijk tot een jaar na het inwerkingtreden van de regeling» (at the latest a year after it takes effect), and the Staatscourant items of the past twelve months with Opiumwet in their title, three, include none. Dextromethorphan medicines with a marketing authorisation as meant in article 40, first limb, of the Medicines Act are in any event outside the lijst IA prohibition, which does not apply to «een geneesmiddel waarvoor een handelsvergunning is verleend als bedoeld in artikel 40, eerste lid, van de Geneesmiddelenwet, of een geneesmiddel als bedoeld in artikel 40, derde lid, van die wet» (a medicine with a marketing authorisation under article 40, first limb, of the Medicines Act, or a medicine as meant in article 40, third limb, of that Act; article 2a, second limb, under a). The medicines regulator, the CBG, states that «De afleverstatus dextromethorfan-bevattende geneesmiddelen is in 2008 gewijzigd van Uitsluitend Apotheek en Drogist naar (UAD) naar Uitsluitend Apotheek (UA).» (in English, the supply status of dextromethorphan medicines was changed in 2008 from pharmacy and drugstore to pharmacy only; cbg-meb.nl, read 3 October 2026); the page gives the year only. For dextromethorphan outside an authorised medicine, for example as a powder, whether it falls within lijst IA stofgroep 1 was not established for this cell. The group admits ring closure, «waaronder begrepen chemische substanties waarvan een substitutie kan leiden tot een ringsluiting met structuurelement A» (including substances where a substitution can close a ring with structuurelement A), and lists «tetralinyl-» among the ring systems of structuurelement A, but it excludes «Substanties waarbij het stikstofatoom direct geïntegreerd is in een ringsysteem dat gefuseerd is met structuurelement A vallen niet onder de stofgroep van substanties afgeleid van 2-fenethylamine.» (substances in which the nitrogen is directly built into a ring system fused with structuurelement A do not fall within the group). In a morphinan the nitrogen's ring is bridged to the saturated ring that is fused to the benzene ring; the text does not say which rings form structuurelement A, nor whether a bridged junction counts as fused. The text quoted above does not settle it, and this cell does not answer it. This is stated as at the Opiumwet consolidation in force from 17 September 2026 («Geldend van 17-09-2026 t/m heden», in English, in force from 17 September 2026 until now; Staatsblad 2026, 262), read from a copy of wetten.overheid.nl/BWBR0001941 fetched on 2 October 2026; its stofgroep 1 text is the same as the 9 July 2026 consolidation's apart from typesetting. On the government's official publications service, every Staatsblad item published from 17 September 2026 to 4 October 2026, 38 items, and every Staatscourant item of the Ministry of Health, Welfare and Sport in the same window, 22 items, were read by title, and none amends lijst I, lijst IA or lijst II; the one Opiumwet item among them is the Council of State's advice on the decree behind the 17 September 2026 consolidation, which placed 2-MMC, 4-BMC and NEP on lijst I. A full-text search of the same service for Opiumwet in that window found no Staatsblad item and no Staatscourant item amending the lists. Changes the consolidation marks as having no commencement date are not in force and are not relied on.

Consequences if caught

Capital exposure: none. No Opiumwet penalty attaches to a dextromethorphan medicine authorised in the Netherlands or by the European Union, bought and held as supplied, because lijst I excludes the substance and article 2a, second limb, under a, excludes such a medicine from the lijst IA prohibition. For a dextromethorphan product authorised only in another country that exemption does not apply, and whether the substance falls within lijst IA stofgroep 1 is open, as the legal status sets out. Supply is governed by the Medicines Act status the CBG assigns, pharmacy only (UA); the CBG's register dataset, downloaded on 4 October 2026, carries two dextromethorphan products, both «Uitsluitend apotheek».

If prescribed or medical

As the CBG page described it when read on 3 October 2026, medicines with UA status are «nu dus recept-vrij maar wel uitsluitend bij de apotheek» (so now prescription free, but from a pharmacy only), and it names dextromethorphan as an example.

Documentation

The Opiumwet text read for this cell sets no permit requirement for carrying a dextromethorphan medicine authorised in the Netherlands or by the European Union, because lijst I excludes the substance and article 2a, second limb, under a, excludes such a medicine from the lijst IA prohibition. A product authorised only in another country is not within that exemption, and its status turns on the open stofgroep 1 question.
