Is DMT legal in Germany?
Also known as: dimitri, the spirit molecule
- Legal status
- Dimethyltryptamine is named in Anlage I of the Betäubungsmittelgesetz in its own right. The dossier records the row as „- | N,N-Dimethyltryptamin (Dimethyltryptamin, DMT) | [2-(Indol-3-yl) ethyl]dimethyl-azan“, with the substitution pattern spelled out in the second column and the unsubstituted indole core in the third. That absence of ring substitution is the feature that matters: the entry is the parent tryptamine, so the ring-substituted relatives are elsewhere, some in this same Anlage under their own names and others left to the structure group in the new psychoactive substances statute. Placement is under BtMG § 1 Abs. 1 and the tier is Anlage I, the non-marketable one. Because the substance is named, the narcotics statute answers it and the structure-group statute is not engaged.
- Consequences if caught
- Capital exposure: none. The dossier's penalty column records that no death-penalty regime applies. The provisions are BtMG §§ 29 bis 30a and the dossier supplies the ceiling: not less than five years under § 30a Abs. 1, with a determinate sentence capped at fifteen years by StGB § 38 Abs. 2. No lower band is recorded, so none is stated. This entry also carries the weight of several other rows, because plant preparations containing the alkaloid are reached through it rather than through any listing of their own, and that makes the identification of the alkaloid the common step in all of them.
- If prescribed or medical
- There is no prescription route in Germany for this substance. It sits in Anlage I, which is not prescribable, so a foreign prescription cannot authorise possession.
- Documentation
- For a prescribed controlled medicine on Schengen travel, carry a Schengen certificate issued under article 75 of the Convention implementing the Schengen Agreement, together with the original packaging and the prescription.
- Germany, Betäubungsmittelgesetz, Anlage I, the table row „- | N,N-Dimethyltryptamin (Dimethyltryptamin, DMT) | [2-(Indol-3-yl) ethyl]dimethyl-azan“, placed by § 1 Abs. 1 with penal provisions at §§ 29 bis 30a
