Is 4-AcO-DMT legal in Germany?

Legal status

4-AcO-DMT is placed in NpSG Anlage 1 Nr. 5.1 in Germany, and a compound satisfying that derivation is prohibited without that fact alone carrying a penalty. It is reached by the Neue-psychoaktive-Stoffe-Gesetz through the indole-3-alkylamine structure group, not by a named narcotics line. Two separate printed limbs do the work: „R1 und R2:... Alkyl- (bis C6)“ for the amine substituents, and the ring provision that „Das Indolringsystem kann an den Positionen 4, 5, 6 und 7... Acetoxy-... gruppen“ carry. The two dimethylamino substituents answer the first limb and the acetoxy group at position four answers the second, and both have to hold. That is the shape of an Anlage 1 result: a derivation from a printed core within printed residue limits, entering the Act through § 2 Nr. 1 Buchst. a. It is a different route from the Anlage 2 lines under Buchst. b and a different statute from the BtMG, in which this compound holds no line.

Consequences if caught

Capital exposure: none. Germany has no death penalty and this statute provides no route to one. The two lists in this Act are not the same list. The prohibition in NpSG § 3 Abs. 1 Nr. 1 catches acquiring and possessing the substance as well as trading in it, manufacturing it, placing it on the market, moving it across the border and administering it to another. The offence in NpSG § 4 Abs. 1 is drawn more narrowly, over trading, placing on the market and administering to another, plus manufacture or import for the purpose of placing on the market. Acquisition and possession therefore sit on the prohibition list and not on the offence list, and a compound satisfying the Nr. 5.1 derivation is prohibited without that fact alone carrying a penalty. No German prescription route is attached to this substance and none can be, because it is not placed in any BtMG Anlage and the NpSG regulates by prohibition rather than by supply. The exemptions in § 3 Abs. 2 run to recognised commercial, industrial and scientific uses, which is not a patient route.
