Is CBD legal in Spain?
- Legal status
- CBD (cannabidiol) for ingestion is not authorised as a consumer product (unapproved Novel Food); only hemp-seed-derived topical/cosmetic use is recognised, and cannabis-extract CBD in cosmetics is not permitted.
- Consequences if caught
- Ingestible CBD is sold in a grey market subject to AEMPS/health-authority withdrawal, while CBD flower is treated as cannabis (a narcotic).
- If prescribed or medical
- Cannabidiol is available through standardised magistral pharmacy preparations under Royal Decree 903/2025 (7 Oct 2025) via an AEMPS registry, with preparations over 0.2% THC facing additional controls.
- Documentation
- No paperwork legalises ingestible CBD as a consumer product; medicinal CBD requires a prescription for an AEMPS-registered magistral preparation.
