Is Barbiturates legal in Malaysia?
- Legal status
- Barbiturates are prescription-controlled substances under the Poisons Act 1952 (psychotropic transposition of the 1971 Convention); they are not among the narcotics/ATS of the Dangerous Drugs Act 1952 First Schedule.
- Consequences if caught
- Poisons Act s.30 penalties: a fine up to RM10,000 and/or up to 4 years. Malaysia's mandatory death penalty (DDA s.39B) applies only to First-Schedule dangerous drugs (narcotics/ATS) — barbiturates are not death-eligible.
- If prescribed or medical
- Phenobarbital is dispensed as a prescription antiepileptic (a WHO Essential Medicine); the sedative-hypnotic barbiturates are tightly controlled.
- Documentation
- Carry a prescription and original packaging; obtain any required import approval for controlled medicines.
