Is Tobacco legal in Vietnam?

- Outside the narcotics list. Tobacco is not a chất ma túy under Luật số 73/2021/QH14 Điều 2 khoản 1, because it does not appear in the danh mục annexed to Nghị định 28/2026/NĐ-CP, signed and in force 19 January 2026. In the decree as read: regulated as tobacco, not as a narcotic substance.
- Consequences if caught
- Capital and life exposure. On the instruments read for this cell, Tobacco carries no exposure under articles 248 to 252 of the Criminal Code, because those articles reach a chất ma túy and this substance is not in the Government's list. That statement is stronger in Vietnam than the same statement would be elsewhere, and the reason is worth giving. The four danh mục of the decree extend to muối, đồng phân, ester, ether and muối của đồng phân, that is salts, isomers, esters, ethers and salts of isomers. They do not extend to analogues. The words tương tự and đồng đẳng appear nowhere in the decree, measured. So a substance that is not listed, and is not a salt, isomer, ester or ether of something listed, is outside the definition rather than arguably inside it. Two things still qualify this. The list is amendable: Điều 3 khoản 6 of the decree routes a newly identified substance through Bộ Công an to the Government, so a substance absent today can be added. And this is a statement about the narcotics law only. Vietnam's pharmaceutical, customs and administrative rules were not fetched for this cell and may reach the substance independently. Vietnam sorts drug offences by conduct, and for Tobacco the prior question is whether any of those conducts is available at all. Articles 248 to 252 are each written about a chất ma túy. Luật Phòng, chống ma túy số 73/2021/QH14, Điều 2 khoản 1, defines that term: Chất ma túy là chất gây nghiện, chất hướng thần được quy định trong danh mục chất ma túy do Chính phủ ban hành. A narcotic substance is one the Government has put in the list. Tobacco is not in that list. So producing it is not article 248, possessing it is not article 249, transporting it is not article 250, trading it is not article 251 and appropriating it is not article 252. None of the five conducts engages those articles.

- Tobacco is not dispensed against a narcotics prescription in Vietnam because it is not in the danh mục at all. Any control on it comes from a different instrument, which this batch did not fetch.

Luật Phòng, chống ma túy số 73/2021/QH14, Điều 2 khoản 1, provides Chất ma túy là chất gây nghiện, chất hướng thần được quy định trong danh mục chất ma túy do Chính phủ ban hành. The Government, not the Assembly, decides what is a narcotic substance, and it does so by decree. The decree in force is Nghị định 28/2026/NĐ-CP, signed and in force 19 January 2026, whose Điều 3 khoản 2 repeals Nghị định 57/2022/NĐ-CP and Nghị định 90/2024/NĐ-CP. Four danh mục in seven parts, 694 entries. For Tobacco the placement is not listed. Placements in this batch were settled on the CAS number wherever the decree prints one, because a name that resembles the substance is not the substance: the decree lists 2C-B and Brolamphetamine separately, and Methoxetamine and 3-MeO-PCP separately, and matching on a name alone would have merged them. The offence. Bộ luật Hình sự số 100/2015/QH13 as amended by Luật số 86/2025/QH15, khoản 18 Điều 1, in force 1 July 2025. That amendment substituted articles 248 to 252 in full, and it is the reason this cell separates the conducts rather than saying that Vietnam has the death penalty for drugs. The consolidated text read is văn bản hợp nhất số 135/VBHN-VPQH of September 2025. Method and its limits. The decree is a scanned signed PDF with no text layer; it was rendered at 600 dots per inch and read with optical character recognition in Vietnamese, and the entries that enter this cell were checked against the page images. The Vietnamese in this cell was normalised to NFC before being checked character for character against the cached statute, because the cached file mixes composed and decomposed forms and a literal search against it returns a false zero. This cell states no figure for how often Vietnam carries out a death sentence, and cites no Vietnamese judgment, because none was read.
