Is Tobacco legal in Netherlands?

Legal status

Not a controlled drug. Tobacco is not named in lijst I, lijst Ia or lijst II of the Opiumwet. It is regulated as a consumer product under Dutch and European tobacco law, which was not read here.

Consequences if caught

All three Opiumwet lists were searched and there is no entry. The four groups in lijst Ia are substances derived from 2-phenethylamine, cannabimimetics and synthetic cannabinoids, substances derived from 4-aminopiperidine, and benzimidazole opioids. There is no tryptamine group and no arylcyclohexylamine group in the Dutch list, which is where it differs from the German Neue-psychoaktive-Stoffe-Gesetz, and there is no general catch-all for psychoactivity. There is therefore no Opiumwet offence. Age limits, advertising rules, display rules and the places where smoking and vaping are allowed are set by the Tabaks- en rookwarenwet, which was not read here.

If prescribed or medical

Nicotine replacement products are sold as medicines or as consumer goods depending on the product. No controlled drug prescription is involved.
