Is 2C-E legal in Netherlands?
- Legal status
- Controlled through the substance group list. 2C-E is not named individually in lijst I or lijst II, and it falls within group 1 of lijst Ia, substances derived from 2-phenethylamine. That group was added by the substance group amendment and is in force in the version read here.
- Consequences if caught
- Lijst Ia is the substance group list and it is in force in the version read here. Article 1 defines a stofgroep as a group of substances derived from the same structure, and the prohibition provides that it is forbidden to bring a substance that forms part of a stofgroep in lijst IA, or a preparation of it, into or out of the territory, to prepare, process, sell, deliver, supply or transport it, to have it present, or to manufacture it. Possession is expressly within that list, at limb C. Lijst Ia contains four groups: substances derived from 2-phenethylamine, cannabimimetics and synthetic cannabinoids, substances derived from 4-aminopiperidine, and benzimidazole opioids, the nitazenes. Group 1 is defined as any chemical substance that can be derived from the base structure of 2-phenylethan-1-amine and matches the modular build of structure element A and structure element B, excluding 2-phenethylamine itself and, expressly, aspartame and penconazole. Structure element A includes the phenyl ring, and the ring systems may be substituted at any position with hydrogen, fluorine, chlorine, bromine, iodine, alkyl up to C6, alkenyl up to C6, alkynyl up to C6, alkoxy up to C6, carboxy, alkylsulfanyl up to C6 and nitro groups. 2C-E is systematically named as a dimethoxy substituted ethylphenethylamine, so its ring substituents are of the kinds the definition expressly permits. The prohibition for a lijst Ia substance includes having it present, so possession is within it. The penalty article that applies to a lijst Ia substance was not established here and no term is stated for it.
- If prescribed or medical
- There is no authorised medicinal form of 2C-E in the Netherlands and no prescription route.
- Documentation
- For a prescribed controlled medicine on Schengen travel, carry a Schengen certificate issued under article 75 of the Convention implementing the Schengen Agreement, together with the original packaging and the prescription. In the Netherlands the certificate is issued by the CAK.
