Is Tobacco legal in Mexico?

Legal status
Tobacco is regulated in Mexico outside the drug-control scheme entirely. Articles 234 and 245 of the Ley General de Salud, which are where the Act prints its narcotics and psychotropics lists, do not reach it, and the same Ley General de Salud regulates it elsewhere under its own provisions. No narcotics or psychotropics offence arises from the substance as such.
Consequences if caught
No drug offence follows, because the substance is outside the two lists the offences are built on. Mexico has no death penalty for any offence, which article 22 of the Constitucion Politica de los Estados Unidos Mexicanos settles. The federal trafficking ceiling is twenty five years under article 194 of the Codigo Penal Federal, and the small-scale ceiling is eight years under article 475 of the Ley General de Salud.
If prescribed or medical
No narcotics or psychotropics prescription route applies, because neither list reaches the substance. Ordinary Mexican health and consumer rules govern it instead, and the special prescription duties that articles 240 onward impose on narcotics are not engaged.
Documentation
Carry nothing special on the drug-control side, because this is not a controlled substance in Mexico. Ordinary customs and duty rules still apply on quantity. The whole current text of the Ley General de Salud was searched on 18 September 2026 and articles 234 and 245 do not reach it.
