Is Scopolamine (Devil's Breath) legal in Poland?

- Not named in the Polish national list. Scopolamine, called hioscyna in Polish, appears in none of the three annexes, so it is neither a narcotic nor a psychotropic nor a new psychoactive substance under the 2005 Act. It is a registered pharmacy and prescription medicine.
- Consequences if caught
- Capital exposure: none. Poland has no death penalty, and no drug offence attaches to this row at all on the list as read. No article 62 or article 62b offence arises, because each requires a substance specified in the regulation issued under article 44f. The tropane connection is worth stating plainly: cocaine is a tropane alkaloid and is listed at lp. 112 of group I-N, and the listing is of that compound rather than of the chemical class, so it does not reach scopolamine. This absence is stated as at the consolidated text of 17 June 2024, Dz.U. 2024 poz. 1139, as that text stands after the amending regulations of 30 April 2025, Dz.U. 2025 poz. 598, and of 7 July 2026, Dz.U. 2026 poz. 934, read at api.sejm.gov.pl on 21 September 2026. The power to move the list belongs to the Minister of Health, exercised by rozporządzenie under article 44f of the 2005 Act, and that does not rule out a later rozporządzenie made after the date of this reading.

- Prescribed for premedication and for motion sickness. Hyoscine butylbromide is dispensed for spasm.

- Carry the original prescription. No controlled drug certificate arises, because no annex entry reaches the substance.
