Where the list actually lives

Legemiddelloven section 22 empowers the King to determine which substances, drugs, plants, fungi and mixtures count as narkotika. Narkotikaforskriften section 4 then says the narkotikaliste is set by the department, and that the list and the provisions written into it apply as part of the regulation. So the Act names no drug, the regulation names no drug, and the list does all the work.

That matters for how fast the law moves. A substance is added by amending the list, not by amending a statute. The consolidation read for this work carries its own amendment history, ending with forskrift 26. august 2026 nr. 1682, in force 1 September 2026.

Two tiers, and most accounts only describe one

Every row on the narkotikaliste is narkotika. Only some rows carry a reference to section 5, and section 5 forbids manufacture, acquisition, sale, import, export, storage, possession and use outright unless an exemption is granted under its second paragraph.

Heroin, MDMA, cannabis, psilocybin, mescaline and khat sit in that prohibition tier. Cocaine, ketamine, morphine, codeine, diazepam, methadone and oxycodone do not: they are controlled narcotics with a lawful medical route. The single most common error in English accounts of Norwegian drug law is to describe the whole list as though it were the section 5 tier.

The list closes over substances it has never named

Section 3 defines narkotika to include the salts, stereoisomers, esters and ethers of anything listed, where those have or are assumed to have psychoactive effect, and any mixture containing either. A mixture is defined broadly: solutions, dilutions, extracts, concentrates, tinctures, products of any kind including pharmaceutical preparations, and processed forms, so long as the processing does not chemically change the substance.

Twelve structural groups then sit at the foot of the list. Seven of them are synthetic cannabinoid scaffolds. The others are the cathinone group, the phenethylamine group, the tryptamine group, the fentanyl group and the nitazene group. Each catches any compound derived from a named core by the substitutions it describes, whether or not anyone has listed that compound.

This is why a plant can be outside the list while its preparation is inside it. Peyote is not listed and mescaline is, so an extract of the cactus is narkotika as a mixture while the living plant is not caught as a plant. Ayahuasca works the same way through DMT. Salvia divinorum and the fly agaric are caught by neither route, and the list demonstrably does name plants and fungi when it means to.

The decriminalisation question, and what the statute actually says

Norway is widely described as having decriminalised, or as having tried and failed to. The rusreform bill was rejected by the Storting in 2021, and what changed afterwards was sentencing and charging practice rather than the offence.

The offence is unchanged in the text read here. Legemiddelloven section 24 first paragraph still forbids possessing or using narkotika without lawful access, and section 31 still punishes it with a fine or up to six months, or both. Anyone reading that a Norwegian statute has stopped criminalising personal possession is reading something the statute does not say.

There is, however, a real change pending that most accounts miss. Both legemiddelloven section 31 and straffeloven section 231 carry the note that they are amended by lov 20. juni 2025 nr. 83, in force from a date the King determines, and a new section 31 a is to be added by the same Act. That Act has been passed and is not yet in force, so the law today is the law described above.

What a traveller may carry

Narkotikaforskriften section 19 sets this out precisely. A narcotic medicine may be brought in or out for personal medical use where a doctor or dentist prescribed it and the traveller can document that, by the package label, the prescription or a doctor's declaration.

A visitor without a registered address in Norway may bring up to one month's supply at the stated dosage. A person registered as living in Norway may bring one month's supply bought in Norway, but only one week's supply bought abroad, extended to one month with a declaration from a doctor in Norway on the form set by the Directorate for Medical Products. Leaving Norway, the limit is one month, relaxed beyond Schengen on a doctor's declaration.

Residents of the Schengen area may present an original Schengen certificate instead, issued for Norwegian residents by a pharmacy. Customs may demand the documentation at the moment of entry.
