Is Nitrous Oxide legal in Oman?

Legal status

Controlled as a volatile substance. Nitrous oxide is listed at Group 3, named in the volatile list as nitrous oxide, dinitrogen monoxide, laughing gas.

Consequences if caught

The law puts Nitrous oxide in the third group, which it keeps apart from narcotics and psychotropics from the definitions in article 1 onwards. Conduct distinction. Group 3 is the volatile substances group and the law treats it separately from narcotics and psychotropics throughout. Article 64 punishes consumption only, and adds the same penalty for any other breach of the law or of the regulations and decisions issued under it. Capital and life exposure. None. A Group 3 volatile substance is outside articles 43, 44 and 46 altogether. Article 64 is the only provision that reaches it, and it reads يعاقب بالسجن مدة لا تزيد على سنة وبغرامة لا تزيد على خمسمائة ريال, imprisonment not exceeding one year and a fine not exceeding five hundred rial, for consuming a substance listed in Group 3. Article 43 cannot attach because its own words confine it to the Group 1 tables and Group 2 table 1, and its mandatory death paragraph operates only on article 43 offences. No quantity arises.

If prescribed or medical

There is no prescribing route for Nitrous oxide under this law. The law regulates the third group by punishing consumption under article 64 rather than by licensing supply, and most of its entries are industrial or anaesthetic products rather than medicines.

Documentation

There is no certificate for a Group 3 volatile substance and none is expected, since these are ordinary industrial, aerosol and anaesthetic products. What matters at a border is the quantity and the apparent purpose rather than a document. Where the rule comes from. The instrument is the Law on Combating Narcotic Drugs and Psychotropic Substances, issued by Royal Decree 17/99 on 6 March 1999 and published in Official Gazette issue 643 of 15 March 1999. Two Royal Decrees have amended the law itself. Royal Decree 34/2015 of 5 October 2015, Gazette 1118, replaced articles 5, 6, 43, 47, 49, 56, 59 and 66. Royal Decree 24/2023 of 19 April 2023, Gazette 1490, replaced article 5, renamed the national committee and repealed article 6, and it touched no penalty and no schedule. The schedules themselves were last amended by Ministerial Decision 131 of 2020, made on 28 September 2020 and published in Gazette 1360 of 4 October 2020, which replaced Group 2 tables 1, 2 and 3.
