Nitrous oxide is not a scheduled narcotic in Portugal, but it is among the EU member states that have restricted its recreational availability; it remains an authorised medical/anaesthetic gas and food additive (E942), with sale for inhalation curbed under consumer and public-health measures rather than the drug-decriminalisation regime.
Consequences if caught
Personal possession is not a controlled-drug offence; recreational retail supply is restricted and canisters are seized (over 1,500 in the first quarter of 2025). No death penalty (non-DP).
If prescribed or medical
Nitrous oxide is a lawful medical/anaesthetic gas and food additive; medical and culinary use is permitted.
Documentation
Food-grade cartridges are available for culinary use; bulk canisters diverted to recreational inhalation are seized by the authorities.
