Is Nimetazepam legal in Italy?

Controlled as a medicinal substance. The Ministry of Health compilation carries «nimetazepam» and routes it through Table IV and the table of medicinal products, which is the part of the DPR 309/1990 scheme built for substances that have a lawful prescribed form. Article 14 creates those tables by enumeration and extends them to the salts, stereoisomers and preparations the table text itself names, so the reach of the entry for nimetazepam is set by its own wording. Sitting in the medicinal group does not put nimetazepam outside the criminal articles; it means that supply inside the dispensing rules is lawful and supply outside them is what article 73 reaches. The compilation and its amendment index were read on 18 September 2026, and a later ministerial decree can move the placement.

Consequences if caught

Capital exposure: none. Italy has no death penalty and DPR 309/1990 carries no life term, so the top of the range is a term of years. The ceiling is 30 years, and three provisions build it: article 73 of DPR 309/1990 creates the trafficking offence, article 80 supplies the aggravations, and article 78 of the Penal Code caps a combined temporary imprisonment calculation at 30 years. That figure belongs to the most aggravated trafficking calculation and not to a personal quantity. What puts nimetazepam inside article 73 at all is the table entry «nimetazepam», and the compilation routes that entry through Table IV and the table of medicinal products. The placement is what decides the band: a pharmacy supply of nimetazepam inside the dispensing rules is lawful, and it is supply outside those rules that the criminal article reaches. Acquisition or possession for personal use is handled administratively under article 75, a different track from article 73 and not a milder version of it.

If prescribed or medical

Italy's country level rule, in the dossier's own terms, is that a traveller certificate list or a prescribing summary is not a substitute for the statutory tables, and that acquisition or possession for personal use runs under article 75 of DPR 309/1990 as an administrative matter rather than under the trafficking article. Attached to nimetazepam, that rule meets a placement in Table IV and the table of medicinal products, entered as «nimetazepam», which is the group that does have a lawful prescribed and dispensed form in Italy. The documents that matter for this substance are therefore the prescription and the dispensing record for the actual product, while the table placement and not the paperwork is what decides the legal question if it is asked. The dossier sets out no Italian certificate scheme for travellers carrying nimetazepam and this cell does not invent one.
