Is Mitragynine legal in Italy?

Confirmed against a primary sourceVerified July 13, 2026
Legal status
Mitragynine, the principal alkaloid of kratom, has no separate legal identity in Italy: kratom was inserted into Table I of the narcotics tables (DPR 309/90) by MoH decree of 1 August 2016 on the basis of a mitragynine intoxication case, so the principal alkaloid is controlled together with the plant.
Consequences if caught
Personal-use possession is administrative (art. 75); dealing or trafficking a Table I substance is criminal under art. 73 (multi-year imprisonment).
If prescribed or medical
No lawful medical route — kratom and its alkaloids sit in Table I with no authorised Italian medicine.
Documentation
No lawful personal-import route for a Table I narcotic.
