Legal status
Neither mitragynine nor kratom is a scheduled narcotic under the NDPS Act 1985: mitragynine, the principal alkaloid of kratom, has no separate legal identity — neither the plant nor the alkaloids appear in the NDPS schedules, so they are effectively unregulated together at the federal level (India is a kratom producer/exporter).
Consequences if caught
No NDPS penalty attaches to the alkaloid at the federal level; kratom is not scheduled.
If prescribed or medical
No NDPS-scheduled kratom or alkaloid medicine exists; there is no controlled prescription tier for it federally.
Documentation
No NDPS import controls apply; kratom and its alkaloids are federally unscheduled (India exports kratom).
