Is it legal in Grenada? Drug law, penalties and sources
Grenada has no drug classes and no sliding scale. Every drug offence in its punishment table carries the same figures. This page states what that means, quotes the schedule, and links every substance to its own sourced entry. Legal information, not legal advice.
No classes, and no graduation by conduct either
The Drug Abuse (Prevention and Control) Act, Chapter 84A, sorts substances in its First Schedule into Part I, the list of narcotic drugs under control, Part II, the list of psychotropic substances, and Part III, a list of substances under control which is a precursor list containing chemicals such as acetic anhydride, acetone and ephedrine. Those are the categories of the United Nations conventions rather than the British classes.
None of those three categories appears in the punishment table. The Fifth Schedule, which has effect under section 37, lists the offences and gives every one of them the same figures: on summary conviction a fine of 250,000 dollars or imprisonment for five years or both, and on conviction on indictment a fine of 500,000 dollars or imprisonment for twenty years or both.
Every one means every one. Having possession under section 6(2), production under section 5(2), supplying under section 5(3), importation or exportation under section 4(3), cultivation of cannabis under section 11(2), handling under section 7(1) and the rest all sit at the same maximum. Possession and trafficking are not distinguished by the tariff.
That is a different answer from its neighbour. Antigua and Barbuda kept the British classes and flattened the penalties across them. Grenada removed the classes and flattened the penalties across the offences as well. Neither island graduates the drug penalty by substance.
Two features a visitor should know
Section 21 creates a separate offence of having a controlled drug in possession in or within a radius of one hundred yards of any school premises.
Section 3(2) provides that the Minister may by Order make such amendments to the First Schedule as may be necessary, so absence from the printed schedule is not an answer and this site does not treat it as one.
