Is DXM legal in Slovakia?

Legal status

DXM is excluded by name from the group that would otherwise control it in Slovakia, so it is not itself a controlled substance under that group. The Group II stereoisomer clause of Annex 1 to Act No. 139/1998 reads «Dextrometorfán... a Dextrorfanol... sú vyňaté z tejto skupiny», which expressly removes dextromethorphan and dextrorphan. That is an affirmative exclusion rather than a no-hit: the schedule considered the substance and carved it out, which is a stronger and more durable finding than an absence. Two statutes divide the work. Act No. 139/1998 decides whether a substance is in the three-group list at Annex 1, and section 3(1) classifies narcotic and psychotropic substances by their effects on health into those three groups. The Criminal Code, No. 300/2005, decides the amount category through sections 135c to 135f and supplies the offences at sections 171 to 173. This reading is stated as in force on 18 September 2026. The consolidation of Act No. 139/1998 read was effective 1 January 2026 and incorporates amendment No. 293/2025; the Criminal Code consolidation read was effective 18 August 2026 and incorporates amendments through No. 168/2026.

Consequences if caught

Capital and life exposure. Slovakia has no death penalty. It does have life imprisonment for a drug offence under Criminal Code section 173(5), and that ceiling is not assigned to DXM, because the group that would carry it excludes DXM by name. The instruments give no narcotic threshold for DXM for the same reason. The scale runs from one year to life. Section 171 covers unauthorised possession: one year for a negligible amount of cannabis or tetrahydrocannabinol, two years for another drug in a negligible amount, three years for a small amount, and six years in the aggravated form. Section 172 covers cultivation and reaches fifteen years at subsection (7). Section 173 covers unauthorised manufacture and trafficking, reaching 8 to 20 years at subsection (4) and 10 to 25 years or life imprisonment at subsection (5). Section 135d then scales everything from the negligible amount by fixed multiples: five for a small amount, 250 for a larger one, 1,500 for a substantial one and 5,000 for a large one, with anything above 5,000 classed as extraordinarily large. Those bands become live only if some other listed substance is proved in the material, and then they attach to that substance rather than to DXM.

If prescribed or medical

DXM is a medicine question rather than a controlled drug question in Slovakia, because the schedule excludes it by name. That exclusion is why an ordinary cough preparation containing it is not thereby a narcotic. The prescribing, dispensing and sale conditions sit in the Slovak medicines regime, which this row did not audit, and the State Institute for Drug Control is the body that states them. Treat the detail of the route as unread.

Carry DXM in its original dispensing packaging with the leaflet and, if it was dispensed to you, the prescription, and confirm the position with the State Institute for Drug Control before you travel. That is the carriage answer, and it is worth keeping the packaging precisely because the exclusion is what distinguishes this from a scheduled opioid.
