Is Crack Cocaine legal in Turkey?

Legal status

Crack cocaine is a controlled substance in Turkey and the dossier maps it to the same schedule name as the powder, «kokain». Turkish law does not create a separate crack entry, and there is no soft and hard distinction anywhere in this chain: article 1 of Law No. 2313 on the Control of Narcotic Substances subjects «ham kokain ve kokain ekgonin ve tropokokain ile bütün milhlerinin», raw cocaine, cocaine, ecgonine and tropacocaine with all their salts, to ministerial control, and the freebase is the same alkaloid in a different physical form. Penal Code No. 5237 names «kokain» in article 188(4)(a) without qualifying the form. Consequences if caught

The article 188(4)(a) uplift names kokain, so the half increase attaches to the freebase exactly as it does to the salt and the preparation method changes nothing about the sentence. Article 188(3) puts the floor for domestic sale, supply, dispatch, transport, storage, purchase, acceptance and possession at not less than ten years, rising to fifteen where the recipient is a child. Because crack is sold in small single use units, the practical exposure turns on whether the court reads the circumstances as trafficking under 188(3) or as use under 191(1), and that reading is the Court of Cassation's on packaging, scales, cash and quantity together rather than on a gram figure in the statute. Article 191(1) sets two to five years and article 191(2) defers the prosecution for five years, with 191(10) adding a half increase where the conduct was within two hundred metres of a school, dormitory, hospital, barracks or place of worship.

If prescribed or medical

There is no prescription route for crack cocaine. The freebase has no medicinal preparation, so the controlled medical use that article 1 of Law No. 2313 leaves open for cocaine does not reach it, and article 24 of that Law punishes any pharmacy sale of a narcotic substance without a physician's prescription under the relevant articles of the Penal Code.
