Is Crack Cocaine legal in Spain?

Confirmed against a primary sourceVerified July 14, 2026
Legal status
Crack is the freebase (base) form of cocaine and has no separate legal identity in Spain: it is controlled AS cocaine, a listed narcotic whose scheduling covers cocaine, its salts and preparations and thus reaches the base/freebase form. As with powder cocaine, private personal use is decriminalised, public possession is an administrative offence, and trafficking is a crime.
Consequences if caught
Public possession or consumption of crack (as cocaine) is an administrative offence with fines (LO 4/2015 Art 36); trafficking is a crime under Penal Code Arts 368-378 (up to 6-9 years for hard drugs).
If prescribed or medical
Cocaine has only marginal controlled medical use in Spain; the crack/freebase base has no medicinal preparation and cannot be prescribed.
Documentation
No prescription or patient documentation exists for crack/freebase cocaine.
