Is Crack Cocaine legal in Cuba?

Legal status
Crack is the freebase (base) form of cocaine and has no separate legal identity in Cuba: it is controlled AS cocaine under the Penal Code (Law No. 151/2022), whose drug-trafficking provisions cover cocaine and its preparations and thus reach the base/freebase form. Aggravated trafficking retains the death penalty on paper (commuted in practice), and this carries over to crack whether powder or base.
Consequences if caught
Trafficking crack (as cocaine) draws 4-20 years, and cross-border or aggravated trafficking 15-30 years, life, or the (commuted) death penalty; simple possession draws about 6 months to 2 years plus fines.
If prescribed or medical
Cocaine has no recognised therapeutic use in Cuba; the crack/freebase base has no medicinal preparation and cannot be prescribed.
