Is Crack Cocaine legal in Cuba?

- Crack is the freebase (base) form of cocaine and has no separate legal identity in Cuba: it is controlled AS cocaine under the Penal Code (Law No. 151/2022), whose drug-trafficking provisions cover cocaine and its preparations and thus reach the base/freebase form. Aggravated trafficking retains the death penalty on paper (commuted in practice), and this carries over to crack whether powder or base.
- Consequences if caught
- Trafficking crack (as cocaine) draws 4-20 years, and cross-border or aggravated trafficking 15-30 years, life, or the (commuted) death penalty; simple possession draws about 6 months to 2 years plus fines.
- If prescribed or medical
- Cocaine has no recognised therapeutic use in Cuba; the crack/freebase base has no medicinal preparation and cannot be prescribed.
- Documentation
- No prescription documentation exists for crack/freebase cocaine.
