Is CBD legal in France?
- Legal status
- CBD (cannabidiol) is legal as a consumer product where finished-product THC does not exceed 0.3%, following the ECJ Kanavape ruling (C-663/18, 19 Nov 2020) that CBD is not a narcotic and the Conseil d'Etat's annulment (29 Dec 2022) of the 30 Dec 2021 order banning the sale of hemp flowers and leaves.
- Consequences if caught
- Compliant sub-0.3%-THC CBD is lawfully sold; a product over 0.3% THC is treated as a stupefiant (narcotic) under the Public Health Code.
- If prescribed or medical
- Cannabidiol-containing medical cannabis is available on prescription under the programme generalised by the March 2024 decree; distinct from recreational cannabis, which remains a stupefiant.
- Documentation
- Keep lab documentation showing finished-product THC below 0.3%; a prescription is required for medical-cannabis CBD.
