Legal status

Controlled in Ukraine as a plant, under a heading that says so. Постанова № 770, таблиці I to IV, consolidated text read on 20 September 2026, prints «Канабіс, рослина» at CAS 8063-14-7, and record UKR-26 accepts that row. The heading is given here in sentence case because the list prints in capitals, and the qualifier in it is load bearing: Ukraine lists the plant itself, and separately prints тетрагідроканабінол at CAS 5957-75-5 as an isolated molecule, so plant material and extracted cannabinoid are reached by two different headings. This source does not state which of таблиці I to IV either heading occupies, and it does not reproduce any industrial hemp threshold, so no percentage figure is asserted in this cell. and the annex places it among the restricted entries rather than the prohibited ones. The перелік approved by Постанова Кабінету Міністрів України № 770, in the redaction of 13 September 2025, prints «Канабіс, смола канабісу, екстракти і настойки канабісу» in Таблиця II, Список № 1, which is headed «Наркотичні засоби та рослини, обіг яких обмежено». The row sits between Фуретидин and the entry for the leaf of Mitragyna speciosa. Three things the applied cell asserted are wrong on the face of the list and are corrected here. The string «Канабіс, рослина» is not printed anywhere in this перелік. The list prints no Chemical Abstracts number against any row, because its two columns are the international non-proprietary name and the chemical name, and the cannabis row carries no chemical name at all, so a placement stated as being at a registry number was stated against a column this list does not have. And the list does say which table the entry occupies. The plant is a separate matter and is printed twice, as «Рослини роду коноплі (Cannabis)» in Таблиця I, Список № 3, for industrial cultivation, and again in Таблиця I, Список № 4, for teaching, research and the manufacture of narcotic, psychotropic and medicinal products. An industrial threshold is printed, contrary to the applied cell: the Примітка to Список № 3 permits industrial cultivation only from seed of varieties whose dried straw did not exceed 0,2 percent tetrahydrocannabinol, and states that from 16 February 2027 that ceiling becomes 0,3 percent. Consequences if caught

Separately from that, and carried forward from this site's published Ukraine entry rather than re-derived from the Code in this pass, the published penalties are these. Personal use of a small amount is administrative under article 44 of the Code of Administrative Offenses, a fine of 25 to 50 tax free minimum incomes, 20 to 60 hours of community service, or administrative arrest of up to 15 days. Above small, personal use under article 309 is criminal, a fine, correctional labour of up to two years, or restriction of liberty of up to five years, rising to up to three years where aggravated or large and up to eight years where a minor is involved. Trafficking or sale under article 307 draws four to twelve years with property forfeiture. Smuggling under article 305 draws five to eight years, and up to eight to ten years aggravated. The published entry records the small, large and especially large quantity thresholds as very low, and that trace amounts have triggered article 309. Drug use itself, other than in public, is not criminal there. Every figure in this paragraph is a penalty range or a fine and none of them is a quantity threshold. They describe the offences that this row's placement in the Ukrainian list brings into play.

If prescribed or medical

Ukraine allows no personal use quantity, наказ МОЗ № 188 grades criminal conduct rather than licensing carriage, and a scheduled medicine must also satisfy Закон України «Про лікарські засоби» on prescription, packaging, import and customs. Attached to this row the placement is the plant heading at CAS 8063-14-7. Ukraine has legislated on medical cannabis in recent years, and this source states none of that framework: no authorisation route, no permitted product, no import permit and no rule recognising a foreign prescription was established here, and none was researched. That is a gap in this record and it is the one a patient most needs closed before travelling.The placement attached to this row is the printed entry «Канабіс, смола канабісу, екстракти і настойки канабісу» in Таблиця II, Список № 1, and that table is the restricted one rather than the prohibited one, which is the whole point of the correction: a restricted placement is the placement a medicinal route can run through, and a prohibited one is not. The source still establishes no Ukrainian authorisation route, no permitted product, no import permit and no rule recognising a foreign prescription, and none was researched. That remains the gap a patient most needs closed before travelling.

Documentation

Carry nothing on the basis that cannabis is lawful where it was bought. If a cannabis based medicine has been prescribed, carry the prescription, the original dispensing pack with the pharmacy label in the patient's name, a prescriber's letter naming the product, the cannabinoid content, the dose and the treatment period, and confirm the Ukrainian authorisation route in advance rather than at the border. Herbal material carries the plant heading at CAS 8063-14-7 and an extract can engage the separate heading at CAS 5957-75-5. Both were read in the consolidated list on 20 September 2026.Name the material the way the annex names it. Herbal material, resin, extracts and tinctures are all inside the single printed entry in Таблиця II, Список № 1, and the growing plant is a separate pair of entries in Таблиця I, Списки № 3 and № 4. Do not quote a registry number at a Ukrainian officer as though the annex carried one, because it does not. Read on 21 September 2026.
