Is Cannabinol legal in Thailand?

Legal status

Controlled as an extract, by the tetrahydrocannabinol content of the preparation rather than by its own name. Cannabinol is not named anywhere in the notification specifying Category 5 narcotics. A cannabinol preparation obtained from cannabis or hemp is an extract, and extracts from every part of those plants are Category 5 narcotics unless one of two narrow exemptions applies.

Consequences if caught

The Category 5 list, in force since 9 June 2565 (2022), reaches this substance by what it is made from, not by what it is called. Clause 1(3) reads 'สารสกัดจากทุกส่วนของพืชกัญชาหรือกัญชง ซึ่งเป็นพืชในสกุล Cannabis ยกเว้นสารสกัดดังต่อไปนี้', in translation extracts from every part of the cannabis or hemp plant, being plants of the genus Cannabis, except the following extracts. The two exceptions are then given in full. The first is 'สารสกัดที่มีปริมาณสารเตตราไฮโดรแคนนาบินอล (tetrahydrocannabinol, THC) ไม่เกินร้อยละ ๐.๒ โดยน้ำหนัก เฉพาะที่ได้รับอนุญาตให้สกัดจากพืชกัญชาหรือกัญชงที่ปลูกภายในประเทศ', in translation an extract with a tetrahydrocannabinol content not exceeding 0.2 percent by weight, only where it has been permitted to be extracted from cannabis or hemp grown inside the country. The second is 'สารสกัดจากเมล็ดของพืชกัญชาหรือกัญชง ที่ได้จากการปลูกภายในประเทศ', in translation an extract from the seed of cannabis or hemp obtained from cultivation inside the country. So a cannabinol extract is a Category 5 narcotic unless its tetrahydrocannabinol content is at or below 0.2 percent by weight and it was lawfully extracted from a domestically grown plant, or it came from the seed of a domestically grown plant. Both exemptions turn on domestic cultivation, so an imported extract does not qualify on its tetrahydrocannabinol content alone.

If prescribed or medical

Not established here. Whether a cannabinol preparation can be supplied on prescription depends on its status as a herbal product or a modern medicine under instruments that were not read for this cell.

Documentation

If a product containing cannabinol is carried, its tetrahydrocannabinol content and its country of origin are the two facts that decide its status, and an imported extract falls outside both exemptions whatever its strength. Nothing here establishes an import route for such a product.
