Is Caffeine legal in Poland?

Legal status
Caffeine is legal everywhere as an ordinary food and beverage ingredient; the notable status in Poland is the EU-wide mandatory high-caffeine warning label. Under Annex III of Regulation (EU) No 1169/2011, directly applicable in Poland, drinks containing more than 150 mg of caffeine per litre (other than coffee- or tea-based drinks) must bear “High caffeine content. Not recommended for children or pregnant or breast-feeding women” with the caffeine quantity in mg per 100 ml.
Consequences if caught
No penalty attaches to ordinary caffeinated foods, drinks or coffee; obligations fall on food businesses, with official food-control enforcement of the mandatory high-caffeine labelling rather than any consumer offence.
