Are Benzodiazepines legal in Montenegro?

Legal status
Controlled in Montenegro member by member, and Montenegro's own Prilog names the members, so this is a finding rather than a deferral. The member by member check was run against the Montenegrin schedule and not merely against the substances this table happens to carry, and it returned six printed names: «Alprazolam | CAS 28981-97-7», «Klonazepam | CAS 1622-61-3», «Diazepam | CAS 439-14-5», «Etizolam | CAS 40054-69-1», «Lorazepam | CAS 846-49-1» and «Nimetazepam | CAS 2011-67-8». The class word itself has no printed row, so what carries the control is the molecule and never the family label, and the specific product has to be identified before any answer is given. One thing in this document argues against itself and is recorded rather than smoothed over: the class row's own search record says a search for «benzodiazepini; alprazolam; diazepam» returned no accepted entry, while six rows in the same table quote printed Prilog entries, two of them for those very names. A printed entry is evidence of a schedule and a search record is evidence that somebody looked, so the printed entries govern here and the search record is reported as the contradiction it is. One further caution: the etizolam entry is a thieno analogue printed in its own right rather than a true benzodiazepine, and the zolpidem entry in this table is an imidazopyridine, so neither is authority for the family as a family. The list is not the criminal code's to move. Član 4 of the Zakon o sprječavanju zloupotrebe droga gives it to the state administration body responsible for health and requires publication in the official gazette: «Spisak droga donosi organ državne uprave nadležan za poslove zdravlja... Spisak droga se objavljuje u Službenom listu Crne Gore.» The version read is the Prilog as those tables stand after the 54/2015 amendment, read on 20 September 2026, and because Član 4 leaves the list with the health administration this does not rule out a later amendment.
Consequences if caught
Capital exposure: none. Montenegro's criminal code carries no death penalty and the dossier records none. The ceiling it records is fifteen years under Article 300 of the Krivični zakonik, the aggravated drug offence, read with the Code's imprisonment rules, and that is the only criminal article this reading names. A foreigner faces expulsion for one to ten years or permanently. Every figure in this paragraph is a penalty band and none of them is a quantity threshold, which is the separate point made above.
