Legal status
Barbiturates are psychotropic substances under the NDPS Act 1985 and prescription drugs under the Drugs and Cosmetics Rules — a class scheduled by compound transposing the 1971 Convention (secobarbital/pentobarbital/amobarbital higher, phenobarbital/barbital lower).
Consequences if caught
Below the notified small quantity: up to 1 year (s.22); intermediate up to 10 years; commercial quantity 10–20 years rigorous imprisonment plus fine.
If prescribed or medical
Phenobarbital is a first-line, widely prescribed Schedule H antiepileptic (a WHO Essential Medicine); the sedative-hypnotic barbiturates are far more restricted.
Documentation
Carry a personal therapeutic amount with a prescription; above the notified small quantity triggers NDPS trafficking liability.
