Is 2C-T-7 legal in Spain?

Legal status

Controlled. 2C-T-7 is listed as a psychotropic substance in Real Decreto 2829/1977. Possession for one's own consumption is not a criminal offence in Spain, and consuming or possessing in public is an administrative infraction.

Consequences if caught

Article 368 of the Código Penal punishes cultivation, preparation or trafficking, or otherwise promoting, favouring or facilitating the unlawful consumption of drugs, and possession only where it is for those purposes. Possession for one's own consumption is outside the article. Where article 368 does apply the penalty is three to six years and a fine of one to three times the value of the drug for substances causing grave harm to health, and one to three years and a fine of one to two times the value in the other cases, and which side a substance falls on is decided in the case rather than by a schedule. Consuming or possessing in a public place, way, public establishment or collective transport is a grave administrative infraction under article 36.16 of Ley Orgánica 4/2015 even where not intended for trafficking, and article 39 sets the fine at 601 to 30,000 euro. Planting and cultivation in places visible to the public is the same grade of infraction under article 36.18 where it is not a crime.
