Is THC-P legal in Turkey?
- Legal status
- THC-P is not confirmed as a controlled substance in Turkey and this row is a deferral rather than a finding. The dossier searched the Turkish terms «tetrahidrokannabiforol» and «THCP» and the transliterations tetrahidrokannabiforol and THCP against the classification decisions made under article 19 of Law No. 2313 on the Control of Narcotic Substances, and confirmed no current entry. It rejected the near match «THC», because THCP has a different side chain. The compound was first identified in cannabis itself in 2019, so it is both a natural constituent and a synthesised product, and it is reported to bind the cannabinoid receptor far more strongly than delta-9-THC. None of that changes a closed list. What does apply regardless of the molecule's status is the plant law: article 3 of Law No. 2313 prohibits the preparation, import, export and sale of esrar in whatever form, and article 23 subjects hemp growing to permission and confines hemp derived medicinal and health products to pharmacy sale under Ministry of Health licensing.
- Consequences if caught
- Capital exposure: none. No article in this chain carries a capital or whole life route, and no per-substance threshold was verified for this row. If a classification decision names THC-P, the ceiling is 30 years under article 188(1) of Penal Code No. 5237, article 188(3) sets not less than ten years for selling, giving to another, dispatching, transporting, storing, purchasing, accepting and possessing, and article 191(1) sets two to five years for possession for use. If no decision names it, the Penal Code articles do not reach the molecule. The compound's potency creates a specific problem in a system with no quantity rule at all: a very small mass is a very large number of doses, and since neither instrument states a weight threshold, the characterisation of a seizure rests on purpose and circumstances, where an unusually potent product invites the trafficking reading rather than the personal use one.
- If prescribed or medical
- There is no prescription route for THC-P in Turkey. It has no medicinal authorisation, the dossier carried no prescription instrument for this row, and no per-substance medical route is asserted here. Any lawful cannabinoid medicine would have to come through the article 23 pharmacy route, licensed and registered by the Ministry of Health, and whether such a product exists containing this cannabinoid is for the TİTCK to state and is deferred. A hemp derived label is not a medicinal authorisation.
- Documentation
- Do not treat an unconfirmed cannabinoid as a cleared product. A THC-P vape or edible is an unanalysed cannabis derived preparation at a Turkish border, the analysis required under article 20 of Law No. 2313 will report every cannabinoid present rather than only the one named on the packet, and a delta-9-THC finding is charged as esrar. Products of this kind are also the most likely in the corpus to be relabelled between batches. The search log was read in the dossier on 18 September 2026 and articles 3 and 23 were read from the consolidated statute on 20 September 2026.
- Turkey, Law No. 2313 on the Control of Narcotic Substances of 12 June 1933, articles 3, 19, 20 and 23, with the Turkish Penal Code No. 5237, articles 188(1), 188(3) and 191(1)
- the consolidated texts were read at https://www.mevzuat.gov.tr/mevzuatmetin/1.3.2313.pdf (HTTP 200, 220,153 bytes) and https://www.mevzuat.gov.tr/mevzuatmetin/1.5.5237.pdf (HTTP 200, 1,070,143 bytes), both fetched on 20 September 2026. The dossier's own url column holds one identical string for all 88 Turkey rows and that string is these two addresses run together with no separator, so the citation it supplies is document level rather than per substance. The annexes to the ten decisions footnoted to article 19 are not reproduced in the consolidated statute and were not read.
