Is Peyote legal in Poland?

Legal status

Controlled through its constituent mescaline, although the cactus is not named in the annexes. «Meskalina» is entry lp. 69 in group I-P of Załącznik nr 1, the psychotropic annex, with the designation «3,4,5-trimetoksyfenetyloamina». A search of all three annexes for Lophophora, for Anhalonium and for the Polish name pejotl returned nothing. That absence is pointed rather than accidental, because Poland does name two other mescaline bearing cacti: «ECHINOPSIS PACHANOI» at lp. 64 and «TRICHOCEREUS PERUVIANUS» at lp. 183 of group I-N, each with the wording that reaches live plants, dried material, seeds and extracts.

Consequences if caught

Capital exposure: none. Poland has no death penalty, and the heaviest band the 2005 Act reaches for any conduct with this substance is a term of years. Possession is an offence under article 62(1) of the 2005 Act and the band there is up to three years. Where the quantity is considerable, article 62(2) sets a band of one year to ten years. In a case of lesser gravity article 62(3) provides instead for a fine, a restriction of liberty or up to one year. Article 62a lets proceedings be discontinued, even before the decision to open an investigation, where the quantity is insignificant and intended for the holder's own use and a penalty would be inexpedient. That is a power of the prosecutor and not an entitlement of the holder, so it is not decriminalisation. So the practical exposure comes from what the cactus contains rather than from what it is, and dried material carrying mescaline is possession of the listed alkaloid. The contrast with Echinopsis and Trichocereus is the fact a reader most needs, because for those two the plant itself is the offence whatever it contains on the day. Supply offences sit apart from possession. Article 56 punishes putting such a substance on the market with a fine and six months to eight years, and article 56(3) raises that to a fine and two years to twelve years where the quantity is considerable. Article 59(1) punishes supply for gain with one year to ten years. This absence is stated as at the consolidated text of 17 June 2024, Dz.U. 2024 poz. 1139, as that text stands after the amending regulations of 30 April 2025, Dz.U. 2025 poz. 598, and of 7 July 2026, Dz.U. 2026 poz. 934, read at api.sejm.gov.pl on 21 September 2026. The power to move the list belongs to the Minister of Health, exercised by rozporządzenie under article 44f of the 2005 Act, and that does not rule out a later rozporządzenie made after the date of this reading.

If prescribed or medical

There is no authorised medicinal product with this substance in Poland, so no prescription route exists for it. Article 33(2) confines group I-P to research, so no ceremonial or medical route exists.

Documentation

No personal import route exists, because a listed substance may be brought in only under the licensing chapter of the 2005 Act and not on a traveller's own account. The certificate issued under article 75 of the Convention implementing the Schengen Agreement is the route for a prescribed controlled medicine and does not reach a substance for which no prescription can be written. Live cactus and dried buttons carry the listed alkaloid, while two other mescaline bearing cacti are named as plants in their own right at lp. 64 and lp. 183.
