Neither mitragynine nor kratom is nominally listed under ANVISA Portaria 344/1998: mitragynine, the principal alkaloid of kratom, is not in the control lists, so as a kratom alkaloid it shares the plant's un-controlled status (flagged for NPS monitoring in 2020 but not prohibited); it remains legal until formally scheduled.
Consequences if caught
No controlled-substance penalty attaches to the alkaloid under current lists; kratom is not scheduled (only monitored).
If prescribed or medical
No ANVISA-registered kratom or alkaloid medicine exists; there is no controlled prescription tier for it.
Documentation
No narcotics import controls apply; kratom and its alkaloids are unscheduled.
