Is Kratom legal in Brazil?

Confirmed against a primary sourceVerified July 13, 2026
Legal status
Kratom (Mitragyna speciosa) is not currently controlled in Brazil — neither the plant nor its constituents are nominally listed under ANVISA Portaria SVS/MS 344/1998; it was reportedly flagged as an NPS for monitoring (2020) but remains legal until formally prohibited.
Consequences if caught
No controlled-substance penalty while unlisted; ordinary ANVISA product and import rules apply, and the status could change if it is formally scheduled.
If prescribed or medical
Not a scheduled medicine — no special-control prescription requirement; it is not an ANVISA-registered product.
Documentation
No kratom-specific carry restriction while unlisted; confirm current ANVISA status before travel as monitoring is ongoing.
