Is LSD legal in Nigeria?

Legal status

Illegal. LSD is named expressly in the National Drug Law Enforcement Agency Act, Cap. N30, Laws of the Federation of Nigeria 2004, at sections 11 and 19, which both read 'the drugs popularly known as cocaine, LSD, heroine or any other similar drugs'. LSD is therefore not reached by inference or by treaty transposition. It is one of only three substances the Act names on its face.

Consequences if caught

Knowing possession is an offence under section 19 and carries imprisonment for a term not less than fifteen years and not exceeding 25 years. Section 11(d) sets the same fifteen to 25 year range for knowingly possessing or using the drug by smoking, inhaling or injecting. Importing, manufacturing, producing, processing, planting or growing it is an offence under section 11(a) and carries imprisonment for life. Exporting, transporting or otherwise trafficking is section 11(b) and also carries life. Selling, buying, exposing or offering for sale or otherwise dealing is section 11(c) and also carries life. The NDLEA Act prescribes no death penalty for these offences.

If prescribed or medical

There is no prescription route. LSD has no recognised medical use in Nigeria and does not appear in the NAFDAC Controlled Medicines Regulations 2019, which regulate handling of narcotics, psychotropic substances and precursors by licensed facilities and do not create a dispensing pathway for LSD.

Documentation

No documentation can authorise possession. The Act qualifies every offence with the words 'without lawful authority', and lawful authority here means a research or scientific authorisation held by an institution, not a traveller's document or a foreign prescription.
