Is LSA (Morning Glory) legal in Thailand?

- LSA is a Category 4 narcotic in Thailand, the category the Narcotics Code B.E. 2564 uses for chemicals that serve to make Category 1 or Category 2 narcotics. The Ministry of Public Health notification ประกาศกระทรวงสาธารณสุข เรื่อง ระบุชื่อยาเสพติดให้โทษในประเภท ๔ พ.ศ. ๒๕๖๖, signed on 26 December 2566 and published in the Royal Gazette volume 141, special part 17 ง, page 13, on 17 January 2567 (2024), names it at item 26 as "ไลเซอร์จาไมด์ (lysergamide)", chemical name "(6aR,9R)-7-methyl-4,6,6a,7,8,9-hexahydroindolo[4,3-fg]quinoline-9-carboxamide", with the condition "รวมทั้งอนุพันธ์ต่างๆ เอสเทอร์ และอีเทอร์ใดๆ ของยาเสพติดให้โทษดังกล่าว เว้นแต่ไลเซอร์จาไมด์ (lysergamide) ซึ่งเป็นส่วนผสมในตำรับที่ได้ขึ้นทะเบียนยาตามกฎหมายว่าด้วยยา หรือ ขึ้นทะเบียนตำรับวัตถุออกฤทธิ์ตามประมวลกฎหมายยาเสพติด", which takes in its derivatives, esters and ethers and excepts lysergamide inside a formula registered as a medicine under the drug law or registered as a psychotropic formula under the Narcotics Code. PubChem lists LYSERGAMIDE as the first synonym of ergine, CID 442072, the d-lysergic acid amide sold as LSA, with the same ring system and (6aR,9R) configuration. Clause 3 of that notification repealed the B.E. 2565 Category 4 list (https://narcotic.fda.moph.go.th/law-type/nc-346) and its amendment, which had carried the same entry as item 24, and amendments No. 2 and No. 3 B.E. 2568 replaced only items 29 and 37 and added items 39 to 41, so item 26 stands. LSD is a different entry, item 49 of the Category 1 narcotic list. Section 91 of the Code prohibits producing, importing, exporting, selling or possessing a Category 4 narcotic without a licence under section 34 or section 35(1) or (3), and section 146 carries the penalty.
- Consequences if caught
- Capital exposure: none. The penalty section for a Category 4 narcotic is section 146 of the Narcotics Code B.E. 2564, and it provides neither death nor life imprisonment. Its first paragraph reads, for a Category 2 or Category 4 narcotic, "ต้องระวางโทษจำคุกไม่เกินสิบปี และปรับไม่เกินหนึ่งล้านบาท": up to 10 years and a fine up to 1,000,000 baht for unlicensed production, import, export, sale or possession. The Code text as gazetted in B.E. 2564 limits the aggravated paragraph, 1 to 15 years and a fine of 100,000 to 1,500,000 baht for trade, public spread, sale to a person aged 18 or under and the other listed circumstances, to Category 2 narcotics only, "เฉพาะยาเสพติดให้โทษในประเภท ๒"; the Thai FDA's own penalty summary page for Category 4 applies that aggravated range to Category 4 as well, and no amending Act explaining the difference was found, so trade in LSA should be treated as possibly reaching 15 years. Sections 162 and 164, on use and possession for use, do not list Category 4, so possession of LSA falls under section 146 itself. The death alternative in this Code sits only in section 145 paragraph 3, it belongs to Category 1 narcotics such as LSD, and it does not reach a Category 4 placement, whatever the quantity. Section 149 is the psychotropic section and is not this substance's section.
- If prescribed or medical
- No lawful route for a traveller was found. The section 39 paragraph 2 exemption for travellers covers only psychotropic substances of Category 2, 3 or 4, so it does not reach a narcotic, and section 39 paragraph 1 allows a patient to carry a narcotic only with a permit and a prescription or treating practitioner's certificate. The only exception in the entry itself is lysergamide inside a formula registered under Thai drug law or registered as a psychotropic formula under the Narcotics Code, and no such registered product was looked for or found in this reading. Any other lawful possession would need a licence under section 34, granted by the Minister, or under section 35(3), which covers small quantities used as analytical reference standards.

- Carry no LSA. Seeds sold for their LSA content, such as Hawaiian baby woodrose or morning glory, are a separate question: the entry names the chemical and its derivatives, esters and ethers, clause 4 of the notification applies the list "ไม่ว่าจะมีความเข้มข้นใด หรือนำไปใช้เพื่อการใด", whatever the concentration or purpose, and neither clause 4 nor the item 26 condition includes a plant material, preparation or stereoisomer limb, while the same list names stereoisomers expressly at items 28 and 29 and names epimer pairs such as ergotamine and ergotaminine, items 22 and 23, as separate entries, so whether seeds, or the isoergine epimer they also carry, are reached was not established here and they should not be assumed safe. The penalties were read from the Code at https://narcotic.fda.moph.go.th/law-type/na-10 and the FDA penalty summary at https://narcotic.fda.moph.go.th/penalty-narco-phycho-volatile-head/category/narcotic-type4. No express open reuse licence was located on the cited pages, so only the wording needed for verification is reproduced, with attribution and a direct link. The status is stated as in force on 3 October 2026, and a later notification can move it, so re-read before relying on this.
