Are Benzodiazepines legal in Belarus?
- Legal status
- Controlled in Belarus member by member, and the Belarusian list names the members, so this is a finding rather than a deferral. The member by member check was run against the республиканский перечень itself and not merely against the substances this table happens to carry, and it returned six printed names: «ДИАЗЕПАМ», «АЛПРАЗОЛАМ», «КЛОНАЗЕПАМ», «ЛОРАЗЕПАМ», «ЭТИЗОЛАМ», «НИМЕТАЗЕПАМ». That distinction decides the cell. The dossier's own class row searched the class word alongside two member names and was recorded as unresolved at BEL-22, but a list that prints individual members is not silent merely because the class word is absent from it. The six are printed in Cyrillic under their own names in the annexes of Постановление Министерства здравоохранения № 19 от 11 февраля 2015 г. республиканский перечень, at records BEL-34, BEL-16, BEL-29, BEL-50, BEL-39 and BEL-69. One of them, etizolam, is a thienodiazepine rather than a true benzodiazepine, which is a further reason the class word cannot be made to do the work that the printed names do. The version read was № 19/2015 with the official 2025 and 10 March 2026 amendments.
- Consequences if caught
- Capital exposure: none. Belarus retains capital punishment in its general criminal law, and that is a separate question from what a drug offence carries. Criminal Code Article 328 provides neither the death penalty nor life imprisonment, so a term of years is the whole of the drug scale here. The figure itself is disputed and the dispute is stated rather than hidden: this repair reads Article 328(5) as a twenty year ceiling, the cell it replaces read the same paragraph as twelve to twenty five years, and the sources reachable here do not settle which reading is right. The earlier cell also framed the offence as articles 327 to 328 with a superscript one, a range this repair does not mention at all, so treat the article range as well as the figure as open. The scale attaches to an offence in a listed substance, and every one of the six named members is listed, so a benzodiazepine question in Belarus becomes a question about which member is in the bag. Belarus sets no lawful personal use allowance. Criminal liability runs on the size bands in the statute and the subordinate law, the band is read against the member's own printed entry rather than against the class, and an amount below every criminal band can still draw administrative liability. A member that is not one of the six printed names is not answered by this cell.
- If prescribed or medical
- The traveller rule is stated at country level and it is the same for every substance in this set: Belarus provides no lawful personal use allowance and no traveller exemption, and a scheduled medicine has to satisfy Закон Республики Беларусь «О лекарственных средствах» as well as the narcotics annexes, meaning prescription, original packaging, and import and customs formalities. The placement to attach here is not one entry but six: each of «ДИАЗЕПАМ», «АЛПРАЗОЛАМ», «КЛОНАЗЕПАМ», «ЛОРАЗЕПАМ», «ЭТИЗОЛАМ», «НИМЕТАЗЕПАМ» is printed in the республиканский перечень, so the medicinal route for a benzodiazepine runs through whichever of those entries names the product being carried. A criminal quantity band is not a lawful traveller allowance. No substance specific medical route is stated in the source and none is supplied here.
- Documentation
- Carry the benzodiazepine you actually hold, named the way the Belarusian annexes name it, with the Belarusian prescription and dispensing paperwork the medicines law requires and the original dispensing packaging. Name the member rather than the class on any declaration, because the class word is what the list does not print and the member name is what it does. The six printed members were read against № 19/2015 with the official 2025 and 10 March 2026 amendments on 20 September 2026, class record BEL-22. A later amendment can add or remove a member, so recheck the annexes before travel.
