Is Benzodiazepines legal in Belgium?

Legal status
Controlled in Belgium member by member rather than as a class, and this table resolves every member it carries. The decree has no class wide benzodiazepine entry: it prints individual names in Annex III. The members that also appear elsewhere in this table are alprazolam, clonazepam, diazepam, etizolam, lorazepam and nimetazepam, each named there in its own right, and the annex names further members that this table carries no row for, including bromazepam and midazolam. The specific benzodiazepine must be identified before any answer is given. A member without a row here is still a named member of the Belgian schedule, and the absence of a row is a fact about this table rather than about Belgium. Flunitrazepam is placed separately in Annex II, and non benzodiazepine hypnotics such as zolpidem are separate entries again rather than members of this class. Belgium works a delegated model: article 2bis §1 of the Law of 24 February 1921 punishes breaches concerning substances whose list is settled by the King, and the Royal Decree of 6 September 2017 supplies that list. The named lists are closed, so pharmacological resemblance, a similar spelling or a substring match cannot enlarge them. Each member is resolved by its printed entry and the class name resolves nothing.
Consequences if caught
Capital exposure: none. Belgium's drug law carries no death penalty and no life sentence. The exposure is member specific. A controlled member reaches article 2bis of the Law of 24 February 1921 through article 61 of the decree, and since the members in this table sit in Annex III while flunitrazepam sits in Annex II, the limb of the member actually proved is what controls the route. Article 2bis §1 sets the ordinary band at three months to five years of imprisonment with a fine of EUR 1,000 to 100,000. Article 2bis §3 raises that to ten to fifteen years for its stated aggravations, including where use following the offence causes death. Article 2bis §4 carries the ceiling, fifteen to twenty years, where the offence concerns a child under twelve or participation as a leader in an association, so twenty years is the maximum imprisonment this statute exposes. Article 2bis §5 allows a further fine of EUR 1,000 to 100,000 in the §2 to §4 cases, which makes that fine available rather than automatic.
If prescribed or medical
The rule that applies to a traveller here is Belgium's own and it is one rule for the whole country: article 3(4)(4) of the Royal Decree of 6 September 2017. It is a document exception rather than a schedule, and it is not a prescribing right. It covers a medicine that was lawfully obtained, carried for the traveller's own personal use, and limited to no more than three months of treatment, and it expressly excludes the substances in Annex II limb A. The placement to attach is the member's. The six members resolved in this table are all in Annex III, which article 3(4)(4) does not exclude, so a patient carrying a lawfully obtained supply of one of them within the three month personal use limit is inside the exception rather than outside it. No route specific to the class was found in this dossier and none has been invented for it.
Documentation
Carry the prescription and the original dispensing packaging naming the specific benzodiazepine, not the class, with a prescriber letter stating the dose and the treatment period and the supply held to three months or less. Annex III and the separate Annex II entry were read on 18 September 2026. The annex text read is the non official consolidated version published by the AFMPS; it is informative and the Moniteur belge controls. The annex consolidation relied on here is valid from 29 March 2026, following the amending Royal Decree published on 19 March 2026, and carries a correction dated 16 July 2026.
