Is 1P-LSD legal in Finland?
- Legal status
- Controlled, though not as a narcotic. Section 1 of valtioneuvoston asetus kuluttajamarkkinoilta kielletyistä psykoaktiivisista aineista 1130/2014 makes the substances in its annex psychoactive substances banned from the consumer market, and 1P-LSD is named there. The entry reads «1p-LSD (N,N-dietyyli-6-metyyli-1-propanoyyli-9,10-didehydroergoliini-8-karboksamidi)». That annex stands as substituted by 650/2026. Section 5 subsection 2 of huumausainelaki 373/2008 bans manufacture, import into Finland, storage, keeping for sale and transfer, and leaves research and industrial use to be permitted separately, so possession for one's own use and use itself are not among the banned acts. Section 3 subsection 3 of the same Act defines the category as substances used for intoxication that may be dangerous to health, notified for control, and that are neither medicines nor narcotics. It is not named in any annex of valtioneuvoston asetus huumausaineina pidettävistä aineista, valmisteista ja kasveista 543/2008, as those annexes stand after 651/2026, 1119/2025 and 650/2026.
- Consequences if caught
- Capital exposure: none. Criminal Code chapter 44 section 5 a carries the separate consumer market offence. It sets a fine or up to one year for manufacturing, importing, storing, keeping for sale or transferring a psychoactive substance banned from the consumer market, contrary to the Narcotics Act. Possession for one's own use and use itself are not among the acts it names. Section 33 a of huumausainelaki 373/2008 adds import and storage duties, and section 23 b allows a university, a research institute or a trader to import and store on prior notice to the Finnish Medicines Agency. Chapter 50 of the Criminal Code (39/1889) carries the narcotics offences. Section 1 sets a fine or up to two years for a huumausainerikos covering manufacture, cultivation, import, export, transport, sale, supply, distribution and possession. Section 2 sets one to ten years for a törkeä huumausainerikos where the object is a very dangerous narcotic or a large quantity, or substantial gain is sought, or the act is part of an organised group, or serious danger to life or health is caused to several people, or the drug is spread to minors. Section 2 a sets a fine or up to six months for a huumausaineen käyttörikos, unlawful use or possession of a small quantity for own use. Section 3 sets a fine or up to two years for preparation and section 4 the same for promotion, while section 4 a sets four months to six years for aggravated promotion. Section 7 allows the charge or the sentence to be waived where the quantity, the circumstances and the use situation make the act minor as a whole, or where the suspect has entered approved treatment. The live Finland cell recorded the same three provisions and asserted no custodial term at all, and every provision it named is carried here: Criminal Code (39/1889) chapter 50, the substantive prohibitions in Narcotics Act 373/2008 section 5 with the lawful exceptions in section 3, and the consumer market conduct offence in Criminal Code chapter 44 section 5 a. The bands stated above are new to this pass and were read off the Criminal Code itself, not carried from that cell. This row is placed outside that regime, so they are recorded as Finland's published drug penalties and not as this substance's exposure. This row in particular. Its entry sits in the annex to valtioneuvoston asetus kuluttajamarkkinoilta kielletyistä psykoaktiivisista aineista 1130/2014, as that annex was substituted by 650/2026, at printed line 16 of the Finnish annex text Finlex serves, and it reads «1p-LSD». In the printed order of that annex the line above it reads 1P-ETH-LAD and the line below it reads karboksamidi). Section 1 of that decree is one sentence and it does all of the work: «Kuluttajamarkkinoilta kiellettyjä psykoaktiivisia aineita ovat liitteessä mainitut aineet.». The penalty limb that placement engages is not chapter 50. It is Criminal Code chapter 44 section 5 a, which opens «Joka huumausainelain vastaisesti tahallaan tai törkeästä huolimattomuudesta valmistaa, tuo maahan, varastoi, pitää myynnissä tai luovuttaa kuluttajamarkkinoilta kiellettyä psykoaktiivista ainetta, on tuomittava» and sets a fine or up to one year, and only where no heavier penalty is provided elsewhere. Section 5 subsection 2 of huumausainelaki 373/2008 states the prohibition this row breaches, «Kuluttajamarkkinoilta kielletyn psykoaktiivisen aineen valmistus, tuonti Suomen alueelle, varastointi, myynnissä pitäminen ja luovuttaminen on kielletty.», and that list of acts does not include possession or use, so the huumausaineen käyttörikos in chapter 50 section 2 a does not reach this row. No quantity threshold and no fine figure is printed for this row in either the decree or chapter 44 section 5 a.
- If prescribed or medical
- A substance banned from the consumer market is by definition not a medicine, which is what section 3 subsection 3 of huumausainelaki 373/2008 says, so no prescription route follows from this listing. Where a substance is a medicinal ingredient rather than a listed narcotic, it is handled through the Medicines Act 395/1987, in particular the conduct and import rules in section 3 and the medicinal substances list, and its status turns on individual product classification. This row in particular. Section 24 of huumausainelaki 373/2008 writes its traveller carve out by reference to the convention lists and this row is in neither decree's convention annexes at all, so the carve out has nothing to attach to. The route in for this category is section 23 b instead, which reads «Elinkeinonharjoittaja saa tuoda maahan ja varastoida kuluttajamarkkinoilta kiellettyjä psykoaktiivisia aineita perustellusta syystä teollista toimintaansa varten, jos aineesta ja toiminnasta on tehty ennen maahantuontia ilmoitus Lääkealan turvallisuus- ja kehittämiskeskukselle.», and that is a research and industry route, not a prescription route.
- Documentation
- The traveller carve out in section 24 of huumausainelaki 373/2008 is written for medicinal products containing convention listed narcotics and does not describe this row. Carry any prescribed medicine in its dispensed packaging with the prescription. Finland's personal import rules for medicines sit in the Medicines Act 395/1987 and were not read for this cell, so no traveller allowance is stated here. This row in particular. What a traveller is carrying, if this row is in the bag, is a substance banned from the consumer market by name at printed line 16 of the annex to 1130/2014, reading «1p-LSD», and import into Finland is one of the acts section 5 subsection 2 of huumausainelaki 373/2008 forbids. There is no traveller allowance to state for this row because the Act provides none for this category: the only import routes are the university and the industry notifications in section 23 b.
