Modafinil in Kiribati: not individually verified

Also known as: provigil

Not individually verified

We have not confirmed that Modafinil specifically is scheduled in Kiribati, so this page gives no legal status. Publishing a guess here would be worse than publishing nothing. What we do know is the governing national drug law, below.

What is on record
Not confirmed. Modafinil is not named in Schedule 2 of the Dangerous Drugs Ordinance, Cap. 23, 1977 Revised Edition, as amended 1995 and 2001, and whether any order under section 13(2) was made after 1977 is not established. No entry in the printed list is named modafinil, provigil or armodafinil, and Schedule 2 is modified by reference to the Single Convention of 1961 under section 13(2). This is a gap in what was read and not a finding that modafinil is lawful or unregulated, because Schedule 2 moves by order. The Poisons List does not name it. The Dangerous Drugs Ordinance was read as in force in the 1977 Revised Edition as amended to the Acts of 1995 and 2001, and this text does not rule out a later amendment or a later order under section 13(2).
