Is Methamphetamine legal in Belgium?

Legal status

Prohibited — Methamphetamine is a controlled substance in Belgium under Loi du 24 fevrier 1921 concernant le trafic des substances veneneuses, soporifiques, stupefiantes, psychotropes, desinfectantes ou antiseptiques, art. 2bis; substances listed by the Arrete royal of 22 January 1998. Belgium is a party to the 1971 Convention on Psychotropic Substances (Schedule II) and the national schedules give effect to that listing.

Consequences if caught

Article 2bis para. 1: imprisonment of three months to five years and a fine of EUR 1,000 to 100,000. Aggravated forms: para. 2 (offence involving a minor aged 16 or over) five to ten years reclusion; para. 3 (child aged 12 to 16, or organised trafficking) ten to fifteen years; para. 4 (child under 12, or a leadership role) fifteen to twenty years. Article 2ter allows the court to impose reduced penalties, including modest fines for a first offence.

If prescribed or medical

Licit narcotics are dispensed under the 1921 law and the Arrete royal of 22 January 1998; a prohibited street drug has no prescribable form.

Documentation

Carry prescribed medicines in original packaging with the prescription; Schengen travellers carrying controlled medicines need an art. 75 Schengen certificate.
