Is Memantine legal in Ukraine?

Legal status
Governed in Ukraine as a medicine rather than as a scheduled substance. Record UKR-56 reports that Постанова № 770, таблиці I to IV, consolidated text read on 20 September 2026, was searched and that no narcotics or psychotropic heading was accepted, and that the regime which applies is Закон України «Про лікарські засоби» with its controls on authorisation, prescription status, labelling, import and customs. The finding is the medicines regime. The absence of a narcotics heading is a negative record from one reading of the consolidated list rather than an independent confirmation. The compound is an uncompetitive receptor antagonist used in dementia, which is why it sits in a therapeutic rather than a controlled category here, and this source does not say whether Ukraine dispenses it on prescription only. Qualify the negative half even here. The narcotics check logs "memantine" and the same word in capitals, both Latin, against an annex the source records as printed in Cyrillic, so the search could not have matched a Cyrillic heading. The expected answer and the measured one happen to agree on this row, but only the first of those is actually supported.
Consequences if caught
Capital exposure: none. Ukrainian law provides no death penalty, and the narcotics ceiling of twelve years of imprisonment under Кримінальний кодекс України, стаття 307, does not reach this substance on this record because record UKR-56 accepted no heading for it. Наказ МОЗ № 188 has no band for it for the same reason. Whatever exposure exists runs under the medicines regime, for supply without authorisation or import of an unauthorised product, and this source reproduces none of those provisions or their penalties, so no article and no figure is stated here. Personal use of a small amount is administrative under article 44 of the Code of Administrative Offenses, a fine of 25 to 50 tax free minimum incomes, 20 to 60 hours of community service, or administrative arrest of up to 15 days. Above small, personal use under article 309 is criminal, a fine, correctional labour of up to two years, or restriction of liberty of up to five years, rising to up to three years where aggravated or large and up to eight years where a minor is involved. Trafficking or sale under article 307 draws four to twelve years with property forfeiture. Smuggling under article 305 draws five to eight years, and up to eight to ten years aggravated. The published entry records the small, large and especially large quantity thresholds as very low, and that trace amounts have triggered article 309. Drug use itself, other than in public, is not criminal there. Every figure in this paragraph is a penalty range or a fine and none of them is a quantity threshold. This row is placed outside the narcotics regime, so they are recorded as Ukraine's published drug penalties and not as this substance's exposure.

Ukraine's country rule states no personal use allowance for a scheduled substance, treats наказ МОЗ № 188 as a criminal grading instrument rather than a traveller's allowance, and requires a medicine to satisfy Закон України «Про лікарські засоби» on prescription, packaging, import and customs. Of those, only the medicines limb engages here, because record UKR-56 is a separate regime finding with no accepted narcotics heading. A traveller is therefore carrying a prescription medicine rather than a scheduled substance. What was not established, and not researched, is whether Ukraine treats the product as prescription only, what quantity may be brought for personal use and whether a foreign prescription is recognised at the border. None of that is stated here, and the prescription should be carried regardless.
Documentation
Carry the prescription, the original dispensing pack with the pharmacy label in the patient's own name, and a prescriber's letter naming the active ingredient, the strength, the daily dose, the treatment period and the total quantity, together with the indication. A patient carrying this medicine is often travelling with a companion or carer, so carry the carer's authority to hold the medicine as well. Keep the quantity within the stated period. The narcotics list was read on 20 September 2026 and record UKR-56 rests on a negative reading of it.
