Khat in Belize: not individually verified

Also known as: qat, miraa, quaadka

Not individually verified

We have not confirmed that Khat specifically is scheduled in Belize, so this page gives no legal status. Publishing a guess here would be worse than publishing nothing. What we do know is the governing national drug law, below.

What is on record
Not confirmed. Khat, qat and Catha edulis returned nothing in either file; Cathinone returned one occurrence and Cathine one. The nearest printed entries are Cathinone in Schedule I paragraph 1(a) and Cathine in Schedule III paragraph 1(a), the two alkaloids the leaf carries. Both alkaloids are named and the plant is not. The volume has no rule that a plant containing a listed substance is itself controlled, so whether fresh leaf falls inside the schedules is not settled by the Regulations, and the Act's Second Schedule, which is where a plant entry would normally sit, was not read. This row is a plant with two separately scheduled alkaloids sitting in two different schedules, which is unusual and is why it is not answered from either one. Nothing in this cell rests on an absence being the whole answer: the Misuse of Drugs Regulations are subsidiary law, and the list that decides whether a substance is a controlled drug at all is the Act's own Second Schedule, which section 4 divides into Parts I, II and III for Class A, Class B and Class C. That schedule is in the Substantive Laws volume of Chapter 103 and was not among the four instruments in the subsidiary volume read, so this row is left open rather than answered. The search recorded above covers the Misuse of Drugs Regulations, the Cannabis Violation Tickets Regulations and the Industrial Hemp Regulations as the Revised Edition 2020 volume prints them, showing the subsidiary laws as at 31 December 2020, together with the 1990 Act text. The schedule placement in this cell is read off the instrument and is not printed in the quoted dossier extract, which names the Act's schedules only as a range.
