Is Gabapentin legal in Jordan?

Whether gabapentin is currently scheduled under Law No. 23 of 2016, which is the Jordanian narcotic drugs and psychotropic substances law, is not established, and this cell says so rather than guessing in either direction. The fallback if it is genuinely unscheduled is article 14(a), which reaches «... من غير المواد المنصوص عليها في الجداول المرفقة بهذا القانون بقصد أحداث التخدير أو أي إثر آخر ضار بالعقل.», “…other than substances specified in the schedules attached to this Law, with intent to cause intoxication or another harmful effect on the mind.” (Art. 14(a)) Gabapentin remains unverified under Law No. 23 because no exact narcotic, psychotropic or precursor entry was recovered and the latest schedule body could not be searched. Jordanian law does not stop at its lists, so absence from a schedule is not a finding of legality. Article 14(a) reaches substances and plants that are not in the schedules at all where they are taken with intent to cause intoxication or another harmful effect on the mind, and article 19(a)(1) separately reaches a plant producing narcotic drugs or psychotropic substances. Because the Law reaches past its own lists, not finding a name in a schedule proves nothing and this cell defers instead of declaring the substance uncontrolled. Schedules are not frozen in the enacted text. Article 37 provides «لمجلس الوزراء بناء على تنسيب الوزير إجراء تعديل على أي من الجداول الملحقة بهذا القانون بحذف أي مادة منه أو إضافة أي مادة أخرى اليه أو تعديل النسب أو المواصفات أو الشروط الخاصة والمتعلقة بأي منها على ان يتم نشر ذلك في الجريدة الرسمية.», which is to say the Council of Ministers, on the Minister of Health's recommendation, may amend any attached schedule by deleting or adding a substance or changing its percentages, specifications or conditions, provided the amendment is published in the Official Gazette. The amending decision belongs to the Council of Ministers rather than to the Ministry acting alone, and Gazette publication is a condition of it.

Consequences if caught

Capital and life exposure. No capital or life result is stated here, because the current schedule status of gabapentin is not established and the penalty depends on it. Two branches follow and neither is chosen. If the substance is genuinely unscheduled, article 14 of Law No. 23 of 2016 supplies non-capital possession, use and trafficking routes, with no weight threshold and with neither life nor death available. If a Council of Ministers decision under article 37 has added it to a schedule since the last searchable consolidation, articles 19 and 20 reach it in the ordinary way, and that means mandatory life under article 19(b) on a listed aggravator and mandatory death under article 20 on the international gang trigger, at any quantity. Stating one branch as the answer would be a guess. The safe reading for a traveller is the harsher branch, because the deferral is about what could be read and not about what is lawful.

No prescribing consequence can be drawn from Law No. 23 of 2016 for gabapentin, because the schedule status that would drive it is not established. The answer is that the control status is unknown, not that the substance is free of medical regulation: a substance can be a prescription only medicine in Jordan without appearing on a Law No. 23 schedule at all. What Law No. 23 of 2016 fixes is the control status, and what it does not fix is the prescribing and dispensing conditions. Jordan's separate medicines and pharmacy regimes were not audited for this table, so a route is treated here as unread rather than as absent.
