CBD in U.S. Virgin Islands (US): not individually verified

Not individually verified

We have not confirmed that CBD specifically is scheduled in U.S. Virgin Islands (US), so this page gives no legal status. Publishing a guess here would be worse than publishing nothing. What we do know is the governing national drug law, below.

What is on record
Not confirmed. CBD is not named in any entry of the federal schedules, 21 CFR 1308.11 to 1308.15 as in force on 30 September 2026, the eCFR text read at https://www.ecfr.gov/api/versioner/v1/full/2026-09-30/title-21.xml?part=1308 on 3 October 2026. The marihuana definition at 21 U.S.C. 802(16)(B)(i) excludes 'hemp, as defined in section 1639o of title 7', which is cannabis with 'a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis'. Pub. L. 119-37, sec. 781, replaces that definition from 12 November 2026 with one measured by total tetrahydrocannabinols. A CBD product above the limit is marihuana material, and that turns on the product, not on the CBD. The territory's own schedules at 19 V.I.C. sec. 595 could not be read in this run, and the territory can control what the federal schedules do not, so whether it is controlled here is not established.
